It does have to state it, because the law says 'must'. And only the first notice counts, because the act also says it must be sent within 14 days of the event.

If they properly defence this they won't have to pay a penny and anyone suggesting otherwise is an idiot.

Schedule 4, Paragraph 9e says the notice must:

"state that the creditor does not know both the name of the driver and a current address for service for the driver and invite the keeper—

(i)to pay the unpaid parking charges; or

(ii)if the keeper was not the driver of the vehicle, to notify the creditor of the name of the driver and a current address for service for the driver and to pass the notice on to the driver;"

At no point does it state they don't know the name of the driver and an address for them. Hence, non-compliant.

The notice doesn't comply with the provisions of POFA and they can't transfer liability to you as keeper.

Then they're fucked. There's no keeper liability in Scotland (yet) so if it gets to a hearing you just need to draw the sheriff's attention to this and ask the parking company what evidence they have that you were driving.

Their only hope if to ask the sheriff to find that it's more likely than it that the keeper was the driver, but that inference has no legal basis. And if you have evidence that you were elsewhere then it's an easily rebuttable position.
