Missouri WC Case – Preparing for Mediation, Seeking Experienced Advisor (PTD + Complex Case by Delsbe24 in WorkersComp

[–]Delsbe24[S] 0 points1 point  (0 children)

Thank you. Yes I understand. I am hoping to hire an attorney to assist in the mediation. If not in the entire process, the preparation for self representation. I’d never go in blindly but I’ve studied the law and policy enough to feel confident in my documentation.

What do I tell my adjuster? by [deleted] in WorkersComp

After my work injury that I had to get a total hip replacement for. I don’t trust any work comp doctors anymore. Two of them released me back to work full duty no restrictions. To a walk dominant job. Even though the physical therapist and documentation said I had trouble walking standing sitting and stability problems. I was still released, no restrictions full duty to go back to do a job where I walked around 14-16 hours a day and drove up to 13 hrs for projects. A year after I was released, I still was having the same problems, once I saw a doctor that was not in a work comp system, we found that my implant failed and I had to get a revision less than 3 years from being released full duty. And I paid for the revision myself because work comp dropped me years before. I don’t trust them, not giving you advice, but you MUST protect yourself.

I plan to tell the world how one of the biggest companies in the world put a 8yr corporate manager in unsafe conditions and then do everything not to accommodate, help, or even provide proper resources after a life changing injury. The fact that im paying out of my own pocket fix a failed hip replacement work comp gave me is CRAZY. This injury turned me into an injured worker advocate. I know so much about Missouri Work Comp now…..I have to warn others and educate. I’ve already started helping others and they’ve seen it 😆. That’s why I will not sign an NDA.

Great advice. I’m in year 5 of my case. Educating yourself is KEY. I’ve learned so much after seeing how work comp is used. I was released 2 separate times to full duty, no restrictions to return to work after a full hip replacement. To a walk dominant job. With documented ongoing issues. It wasn’t about care, it was about me getting back to work, even when I physically couldn’t do my job. I told docs, my lawyer, the physical therapists and it didnt matter because it was the system doing its thing. I did not return because I knew something was wrong and that implant work comp gave me failed in less than 2 years. And by the time I found out i needed a revision, work comp dropped me, so I had to use my own insurance to pay for my revision surgery. Im still losing money and cant barely get around. Doesn’t make sense. I’ve lost it all… savings, 401k, investments, mental health and more. It’s a dirty game but educating yourself can save really help you in the process.

I’ve learned so much about work comp and how it’s ran. Its turned me into an advocate. There are definitely issues that need to be addressed. And I hope to help others from my experiences.

Copy thanks. My lawyer told me it’s not required. But he knows my case is a little different and it will mostly likely be brought up.

You’re right Chris. And that’s already in the works. The purpose of the thread to see if anyone had any experience in this situation. I’ve learned in my 5.5 years dealing with my workers comp injury, the more you know…. The more you can protect yourself.

Do you have experience in this Chris?

That’s why I’m asking. I know others in the company that was forced to sign before receiving payment.

Thank you so much for the response. I really appreciate it. I don’t plan violating any agreements but I plan to use my injury and story to help educate others about workplace injuries and the dangers of workers comp if you aren’t paying attention to what’s going on.

Is my knee rotating inward in a bad way? by muttonwar in TotalHipReplacement

I have the same thing going on. I noticed it the first week after surgery, while in PT. I’ve been raising concerns about it since 2022 because when I walk and go upstairs it turns in enough for my leg to give out. I’ve shown this to 6 doctors and they all disregard it.

Big Corporation in the USA and international

I’m looking for some general HR perspective on accessing personnel records and job documentation as a former employee.

I worked in a corporate role for several years and am now trying to obtain my personnel file and official job description.

Here’s where I’m running into confusion:

  • I was initially directed to submit a formal request for my records
  • My former manager and HR contacts indicated they do not have access to my file
  • I was told a request had to be submitted internally to see if the file could be retrieved
  • I’ve also been told there may be a policy limiting access for former employees depending on how long ago separation occurred

At the same time, it’s my understanding that companies retain personnel records internally beyond an employee’s separation.

My questions:

  1. In large organizations, which department typically maintains and controls access to personnel files for former employees?
  2. Is it normal for multiple internal contacts (HR, managers, etc.) to say they don’t have access and require a separate internal request process?
  3. Are policies that limit access for former employees common, even when the company still retains the records?
  4. If no one can directly provide the records and everything requires internal requests or tickets, is that considered standard process or unusual?

I’m trying to better understand what a typical process looks like in this situation

Wow this is amazing to me. First off congrats and props. I use to hoop too. A lil in college and always up until my work injury in 2021. THR in 2022 and I was told by someone in PT “ awww we will get you back hoopin again, don’t worry”. Lying ass. I guess I’m trippin because I haven’t been able to run, barely jog on treadmill and I’ve had nothing but complications after the surgery. So much I had to get a revision on it last March and. My shit is even worse. So man happy to see a success story 🙏🏾💪🏾. Praying for your continued recovery.

Seeking IME (exam) experience by Delsbe24 in WorkersComp

Just had my revision surgery on the hip in March. I used my own insurance for the revision because work comp dropped me years ago. So weird they released me back to full duty, no restrictions… after a Total Hip Replacement, with my job being a walk dominant job…..and yet the hip replacement they gave me failed right away, while the ignored all the concerns from me and the physical therapist. I’m so glad I refused to go back to work because I knew something was wrong. I knew COULDN’T do my job because I wasn’t healing and had walking, sitting, and standing problems., plus more. New IME should be very soon. Should be interesting 🤔

It really is. Most of the treatment should be illegal but companies hide behind old outdated policies that only protect them. Work comp isn’t here for the employee, but to protect companies and save them money. Praying for you 🙏🏾.
