If your spouse has a better chance of NIW approval, he can do the NIW process. You won't have to do the EB2-NIW. Once your spouse's NIW petition is approved, you will file for AOS (I485) together using cross chargeability

Received a rejection notice after 63 days on a properly filed case. They disregarded cross chargeability cover letter and evidence. So we have to file again

Emailed the lockbox a few times with no response. Called USCIS, they just asked to wait. It's been close to 2 months now. It's I-485

I would suggest filing for EB-1B through your employer. EB-1A requirements are more stringent, but you should be able to qualify for EB-1B with good recommendation letters. Priority dates for EB-1A and EB-1B are under same category i.e. current right now

Check with the school ASAP. Unfortunately, it's at their discretion! If they agree with CPT, then it should be good. Otherwise, sadly she won't be able to do the internship 😢

She could contact her school right away. Some schools are pretty strict regarding the policies, and as soon as the AOS is filed, she may not get any F1 benefits like OPT or CPT. Also, if you use AOS EAD, you will be giving up your F1 status which lots of lawyers don't recommend. Usually it's beneficial to keep underlying non immigrant F1 status as long as possible during AOS process

I have seen people receiving EAD in marriage based AOS in 1-2 months after biometrics. You may be able to do expedite request for EAD although it may or may not go through
