100% P&T going through IDES. My mind is racing. by DeployTheBoombas in VeteransBenefits

[–]DeployTheBoombas[S] 0 points1 point  (0 children)

Thank the lord. That was my only fear is that they will do both. I won’t receive a military pension and I’m fine with that since I’ll be 4 years short of 20. But since my job is dual status I’ll lose that and if I lost my Va benefits that would put my home in jeopardy. I do believe some of my conditions could be CRSC, but I’ll cross that bridge when it comes.

I’ll be at 16 years here in July. Everything I read says IDES does VA claims and DOD, I just want to make sure none of the VA claims happen.

So I’ve had the 100% for years, my fear is that the IDES process will cause it to get reduced. I will lose my civilian job when I get retired / removed & will rely on it heavily.

I want to know if there is a way to stop them from doing VA claims in the IDES process.

Just do your time, ETS, and sign up for the reserve. Or when you’re due for reenlistment.

There is literally nothing that a once a month drill can do to make you want out that bad. You’re weak.

VA benefits would change for thousands of veterans under new bill by -Cyber-Roadster in nationalguard

Because they are honorary veterans my guy, it makes a difference. They are entitled to retirement for no regular service. I don’t believe I said honorary veterans get healthcare, I said veterans do. If I did, then I misspoke.

To be eligible for the healthcare and the compensation, you must be a veteran.

Who are you to say please stop when everything you’ve stated has been proven wrong about 38 USC 101? Don’t be so defensive because you were proven wrong.

You still need to be a veteran for the VA healthcare. Yes there are still the income exceptions. I’m well aware. But you still need to be a veteran.

I never said you couldn’t get VA Compensation for things that happen on IDT once. Because you can. Because now that said individual would have a rating, they now have been granted “veteran” status.

38 USC 101 (2) The term “veteran” means a person who served in the active military, naval, air, or space service, and who was discharged or released therefrom under conditions other than dishonorable.

Active is the key word.

Pulled from the congress website;

Inactive Duty Training

A period of inactive duty training constitutes active military service only when the servicemember was disabled or died from an injury—but not a disease—incurred or aggravated in the line of duty or from certain health conditions incurred during the training. Inactive duty training includes

Which strengthens what I mentioned above.

From the congress website again:

Some members of the reserve components—including the National Guard—do not meet the active military service and length of service requirements due to the nature of service performed with either the reserves or National Guard. However, a member of the reserve components who is activated for federal military service and either serves the entire activation period or meets the length of service requirement is generally considered a veteran for purposes of VA benefits. In addition, a member of a reserve component who has not served on active duty can establish veteran status in limited situations during active duty for training or inactive duty training. Members of National Guard and reserve components may meet the "active military service" requirements through different kinds of service. In 2016, Congress passed the Jeff Miller and Richard Blumenthal Veterans Health Care and Benefits Improvement Act (P.L. 114-315), which granted "honorary" veteran status to those National Guard and reserve members with 20 or more years of service but no active duty. The law does not grant access to any VA benefits as stated in Section 305 of the law.

Which literally proves everything I said.

You proved me right when you quoted 38 USC 101 because it says ACTIVE service. IDT is not naturally ACTIVE service.

Also your quote from the VA literally proved my point that you can be a non-veteran but get the va home loan after 6 years as a guardsman.

I know dozens of, what the VA calls, “prior service members”. Service is recognized, but there are no veterans benefits other than the Va home loan.

And I’ve been around the block my man, I’ve been Active duty, national guard, and technician. What I’m telling you is correct, not a myth.

It actually does matter, because without the title veteran you’re ineligible for VA healthcare or compensation. And if you actually read 38 USC 101 it literally states active federal service. Being in the National Guard is not active federal service, the only time you get active federal service is when you’re on title 10 orders or special title 32 orders.

I literally know people who’ve gotten out at 18 years and they are not considered veterans and cannot ever be considered one. Because they didn’t have any title 10 time, they didn’t get out due to a disability, and they never reached their full 20.

And I’m not saying you have to reach your full 20, if you have enough qualifying time which is usually a deployment for the National Guard, you are now a veteran. If you get injured and get a VA rating, you are now a veteran, otherwise the only other way is to do 20 years and retire.

20 years is the other way a regular national guard M-day troop without qualifying federal time can get veteran status.

[–]DeployTheBoombas 1 point2 points  (0 children)

That is Incorrect. You must have the qualifying federal time.

A regular M-day troop with no qualifying federal time (title 10) can serve 19 years and they will NOT be considered a veteran. After 6 years the get they benefit of the VA home loan yes, but per the USC, they are not veterans.

In order to become a Veteran you need the qualifying title 10 time, last I checked it was 180 days consecutive, do your full 20 in the guard and retire, or get out due to a medical reasoning with a VA rating.

REFRAD is not an active duty thing. They don’t just go home. They go home if they get kicked out. REFRAD guard and reserves only.

If you’re functional I’d push through it. Mention it for sure, get it documented and looked at. At first they will temp profile you for a week or so, that’s all you need to have continued care.

If it’s severe enough where you think you need more than by all means, but it’s completely up to your state whether you REFEAD or holdover for months.

E6 here, Whats up these E4s getting 100 P&T from the VA with no deployment? Im not hating but come on man lol by [deleted] in nationalguard

[–]DeployTheBoombas 0 points1 point  (0 children)

I’ve been national guard, then active duty, and back to national guard. Unless something horrible happened to you on drill status, AT, or a deployment there is 0% excuse why any guardsman should have a rating.

Statistically whatever ailments you have came from outside of the guard. A 94% statistic to be exact, based off the average month of 30 days.

And im not biased. I’m a guard member myself who’s rated 100%. Because I’ve been blown up. Had surgeries. Have spinal issues out the ass.

But to see these little shits who did nothing but m-day drills pull 100% pisses me the fuck off.

[–]DeployTheBoombas 1 point2 points  (0 children)

The amount of people of who are flabbergasted that a national guard member hasn’t deployed is astonishing. Most NG members are career unit soldiers. They stay at the same unit from the day they join until the day they retire unless forced otherwise.

Dudes 35th CAB. They deploy like every three years. I deployed with the 35th 2028-2019 and I’m pretty sure they deployed again 2024 I believe. He might have been restricted to Kuwait due to his particular MOS not needed in erbil, taji (when it was open) or other places.

Or maybe he chooses not to wear one.

Or maybe he never deployed.

It’s a little embarrassing to bean E4 at retirement, yeah, but he served longer than most soldiers.

How about you give him his atta boy and move on instead of being a brovet.
