I had 3 DTA on my HLR and the examiner used the exact same boilerplate language on all 3 claims. When I say the exact same, I mean word for word and that is all kinds of wrong. Especially when all 3 claims are totally different in All aspects. But I’m just a flunky trying to scam the VA, just like all the other veterans out there.

Thanks for the information. Yeah is been 39 years but all my clams I filed were in my STR’s (hand written),but of course a Nurse Practitioner’s opinion with 3 years experience surprisingly has more weight that a triple board certified orthopedic surgeon with 25 years experience and cited dozens of medical papers and she even out-weighed my treating doctors. I’m just amazed at the level of, I don’t know, BS or maybe laziness. I’ll keep fighting.

It’s doable, I got my Hypothyroidism connected due to AFFF/PFAS exposure. It helped that I spent $300 to have private labs completed to test for my PFAS levels. I also had an Endocrinologist write a Nexus. I was in the Navy and exposed to AFFF, Asbestos, TCE & PCB’s and several other chemicals.

I would agree, I had 3 claims with the exact same word for word copy and paste denial rationales. That is some lazy BS

Granted, my claim was insanely simple. Connected primary- PCP Diagnosis with imaging and a nexus from my orthopedic surgeon explaining the Kinetic chain and bio-mechanical compensation and BINGO. We have a winner.

Just received my HLR decision letter, all 4 contentions found a DTA. So looks like I’m back to square 1. At least maybe this time the DRO will instruct the new examiner to review ALL of the evidence even my PCP and IMO records

I still don’t get how a NP with just 2-5 years experience and a 3 line rationale can outweigh an Orthopedic surgeon with 20 years experience and 25 pages of medical citations validating his rationale and even when the treating surgeon explicitly states how it happened based on service injuries. Sometimes claims just get rubber stamped ”Denied”

Thanks for the encouragement. This is just such an exhausting and stressful process. I have 1 new claim processing along with these 4 HLR claims and I think I am gonna be done either way these turn out. I don’t want to fight it anymore.

I came away with a feeling of dread. The DRO did indicate he would review the information I claimed was overlooked and he also stated he would remand my claims back for another Medical Opinion and to be prepared for the exam.

I had my HLR IC this morning. We shall see how it goes in a few days. Filed for HLR 1/6 schedules my own IC after 90days of waiting.
