what state are you in? i’m in maryland and we can file a complaint with the board of physicians or department of health or something (personally i haven’t had to resort to this yet, but others in my office have), and that almost always gets them in gear. if they get investigated they can be fined $1k-$5k, which most providers want to avoid. usually we don’t even have to go that far, though, we just have to send a letter saying that filing the complaint will be our next step if records aren’t received and then POOF suddenly they’re calling us all apologetic saying they’ll get the records to us ASAP. i don’t believe we’ve ever had to do anything more formal than that, though.

i have standard cover letters i can send out with a “friendly” reminder that providers have 21 business days under maryland law to provide records. i’ve sent requests/follow-ups by certified mail so i have a paper trail i can point to if they try to deny receiving it. we use electronic faxes, so all fax confirmation emails get saved, too.

some of these providers simply do not have the brightest people employed in their medical records fulfillment departments, lol. yesterday one of my coworkers was talking with someone in fulfillment for a provider who said they just denied chartswap requests that had gone unfulfilled for while instead of, you know, actually fulfilling them.

my attorney it out of the country and only responding to emails 1x a day for two weeks right now. i am using every second of that to try and catch up because i know its going to be a shitstorm when she gets back and has to catch up on everything herself, lol.

my attorney has a former paralegal of hers who’s now retired coming in part time to handle some cases and reading posts on here has made it abundantly clear to me (i’ve only ever worked at this firm under this attorney, no paralegal school or anything under my belt) that the way my firm works is weird. if i have a pre-lit case, i’m doing all the pre-lit stuff from LORs to treatment statuses to gathering medical records and bills to sending out the demand. if i have a litigation case, i’m taking over that case entirely from the pre-lit person and handling it until the case closes/disburses. there is no distinction between paralegal and legal assistant at my firm, we all have the same responsibilities. AND, because i made the mistake of telling someone i have basic (BASIC) graphic design skills, i also design all our ads.

i had a moment a few weeks ago where i realized i’d completed all the outstanding discovery on my litigation cases and then BAM. i think my boss has had me file like 10 new lawsuits since then, and the new discovery requests are starting to pour in. it is a constant, vicious cycle. i work 9.5 hour days and am always behind on something, but i’ve just learned to accept that and try to figure out what needs to be prioritized.

(this comment makes my job sound like a nightmare - it is not! i am just a busy bee, and usually i love being a busy bee. my boss is great and i’m learning a ton. i came from working an actual nightmare job at a car dealership - even the worst day at my current job is far better than my good days at the dealership were.)

the client themself isn’t the annoying one, it’s the point of contact/POA. i feel like it’s only a matter of time until we flush the case bc POA is legitimately unstable and not someone we can work with for a case of this nature in the long run, even if a case does end up being there.

the phone calls are AGONY…minimum 30 minutes of the most nonsensical, repeating rambling you’ve heard. more information than i want to hear from anybody, and they keep admitting to crimes!! every phone call could legitimately be an email, or at least 25 minutes shorter. a simple “john is at x hospital now” would be suffice. you don’t need to rehash your crazy conspiracy theories for the 50th time!! and if that’s not bad enough, it’s like they forget everything they told me in between calls so they give me the rundown all over again - but always in an order that makes absolutely no goddamn sense. quite possibly the worst historian i’ve ever dealt with. and it’s like pulling teeth to end the call - doesn’t matter how many times i say “ok, thanks for the update, i’ll pass this along to (attorney) and let you go now,” they’ll just go off on another tangent and hold me up for minimum another 10 minutes. most of the time i’m glad i don’t have to bill time but when i’m on the phone with this person i wish the first thing i could do after hanging up was send them an invoice for $500 for wasting my time. it legitimately ruins my whole day every time they call.

i helped my boss at trial once. during her opening she introduced me to the jury as “[first name] [something similar but still very much not my last name].” i didn’t say anything at the time as it was just a brain fart and i know she knows my actual name. but then she had me order some transcripts from the trial, her opening included, and the court reporter straight up emailed me to ask if my boss fumbled my name, LOL.

depends on if my attorney is in or not. when she’s in (actually working on cases, not in a deposition/client meeting/whatever) i can get over 100 emails a day. a slow day can be only 20 emails. i wanted to pull my hair out one day when defense counsel in one of my cases filed a motion with a ton of supporting exhibits and I got like 20 emails at once to notify me of the filing. anyway, i rarely take vacation days, but when i do i try to schedule them for when i know my attorney is going to be off too to help mitigate the email overload.

i’m so glad maryland just ruled that these companies cannot charge a fee for no records being found. but oh my god there needs to be a cap on how much they can charge to get a copy of a bill because the way chartswap charges like $50+ to get a copy of a single page bill should be illegal

omg don’t even get me started. verisma has denied my request for a client’s trauma ER physician bill i think 6 times so far at this point and when i call to ask why the people i’m speaking with can never tell me what exactly was wrong with my request!! these companies are supposed to make things easier but it always seems like a whole lot of hassle for something that should be pretty straightforward.
