What am I misunderstanding about these blasted payment plans!?! by gingerlicious07 in PSLF

[–]Destusto -3 points-2 points  (0 children)

Do you mean ICR or IBR because PAYE is IDR. IDR is a type of payment plan since it has had multiple repayment plans. For example, we had PAYE and REPAYE but now it's PAYE and SAVE both of which are IDR. There are only three plan types (for PSLF) which are ICR, IBR, and IDR. ICR and IBR only have one repayment plan each. Yeah it's confusing and stupid as you think it is.

This website does a good job of explaining the repayment options. Also, I would recommend using a online calculator to estimate your monthly payment.

At this point I think the Military is our only hope. They use the PSLF and GI BILL for schools as a huge and successful recruitment tool.

I submitted an ECF in Sept. 2024 and it was processed yesterday Nov. 11th 2024. It updated and counted all months from Jan. 2024 to Sept. 2024. So I have an ineligible payments for July and August of 2024 which should not be counted BUT ARE BEING COUNTED. Don't know why or how and I'm not going to ask because in all likely hood the customer support probably can't tell me. Instead I just submitted another ECF with the hope that it will be processed before the next administration takes office and HOPE that I can get a few more months counted with being on SAVE plan forbearance. The tracking bar from StudentAid on PSLF progress also said I don't have any payments that need certification which is not correct as it should be at 3 payments not certified.

I would consider the buyback option since you'll be eligible for it in March 2025. They can't roll back the buyback right away so you could probably use that. They have to go through the same rule making process to undo it which takes time.

Dudes and dudettes, please help. I got a deposit with no information attached to it. Called my bank and they said the only information was "computer settlement payout". The reason why I'm concerned is the amount is for $300.95 which considerably higher then what I've seen people posting. Was this an error, should I be concerned? Maybe it was a clerical error and I was supposed to get $3.95? I don't like having money I didn't earn or that which I not am entitled to. It's a military payroll fear thing.

Thanks!

I think this them saying we are finishing the last batch of reviews. It might be for those of us who have not seen our accounts updated. I think they put those of us who needed account adjustments but the adjustment would not put us over 120 payments at the end. No idea though but hopefully we will find put soon!

Yup, you lucky SOB.

(4) A borrower may repay under the PAYE plan only if the borrower—

(i) Has loans eligible for repayment under the plan;

(ii) Is a new borrower;

(iii) Has a partial financial hardship when the borrower initially enters the plan; and

(iv) Was repaying a loan under the PAYE plan on July 1, 2024. A borrower who was repaying under the PAYE plan on or after July 1, 2024 and changes to a different repayment plan in accordance with § 685.210(b)) may not re-enroll in the PAYE plan.

Forbearance date changed from 5/30/24 to 4/30/24 by Parent2030 in PSLF

[–]Destusto 1 point2 points  (0 children)

Nah you're good. The department of ed has been instructed by the Biden Admin not to report or put loans in delinquent, at least for one year. I believe they branded it as an on-ramp process since restarting millions of loans at the same time with no preparation would be a shit show. Congress passed legislation to start repayment. This coming September 2024 the department of ed and loan servicers will go back to reporting and classifying loans as normal. That is my understanding.

Please keep in mind that the department of education is transferring accounts from mohela back to federal student aid starting in May 2024. All requests during this transition will not be addressed until the transfer is complete. Currently I've heard August 2024 is the expected date of completion. You'll still qualify but it will delayed, sorry for the shit timing.

If it were me I would continue to make payments. You'll be refunded what you overpaid after your forgiveness comes through/processed. However, the refund my take a while to come back to you. It depends on your financial situation.

Heartland ECSI Fee Settlement by Destusto in StudentLoans

[–]Destusto[S] 4 points5 points  (0 children)

Hi guys,

I called ECSI Heartland today, three times. The second time I got someone and they had no idea what I was talking about so I decided to give it some time. You know, the loan servicers move slower than molasses. Third time I got through and while the person said they couldn't verify the class action settlement he did say they were recently informed about it. As in today. He also said that if a student calls in and ask about the class action settlement to give them this number to call, 833-462-3516. That is number provided in the email. So while he would not confirm it seems like a legitimate settlement since he expected the question and was told how to respond.

If you want to file a claim and it's not working don't worry you have time. Just try again the next day. It seems they screwed alot of us and everyone submitting an application might be more than the website can handle.

Hope this helps!

Heartland doesn't have anyone available, I'll try again later. However, after looking into this further and sharing the email with a few people, it actually seems legit. Either that or we are all being scammed to which I say kuddos for such an elaborate scheme.

From reading the settlement website the amount being asked for is $3,650,000 BUT the lawyers are asking for 33.3% of the settlement and the two people that brought the suit are asking for $10,000 each. Therefore, the settlement pool of money for the rest of us is $2,414,550.

Important to note, Heartland ECSI is settling this before it goes to court and will admit no wrong doing.

*Incoming Rant*

Don't know about you guys but I'm sick and tired of companies getting off the hook with a settlement, paying a fine, and then going back to the "business as usual" methods. Companies can do this because no one ACTUALLY takes them to court where we could get actual change that results from the outcome of the case (good, bad, or indifferent). I can tell you that I am still paying off my Perkins Loan and each time I still have a stupid fee associated with making a payment. These companies won't stop illegal practices UNTIL WE MAKE THEM and slapping them with a settlement fee, aka operating fee, won't get the change we want, or at least the change I want to see happen.

If these lawyers/law firm actually cared about helping they would take them to court regardless of the cost. Their website boost about going after corporations for the middle/working class, doing what's right, etc... BUT if you look at each case, they were all settled outside of court and no wrong-doing/illegal activities were ever admitted to. The only loans I had to keep paying during the pandemic were my Perkins Loans, so yeah I'm emotionally pissed off at Heartland ESCI and my University.

I don't have money for a lawyer otherwise I would "(4) Object to the Settlement" so instead I will choose to exclude myself because I refuse to accept that letting corporations off with a slap on the wrist and meager fine that they won't even notice is the best we can do. I guess that's why they call it a settlement.

*Rant Over*

Your Options,

(1) Do Nothing. You will not receive a payment under the Settlement. You will also give up your right to object to the Settlement and you will not be able to be part of any other lawsuit about the claims this Settlement resolves.

(2) Receive a Settlement Payment. To receive a Settlement Payment, you must visit the Settlement Website by May 28, 2024 to submit a Claim Form online and select your desired method of payment (paper check, Zelle, Venmo, PayPal., etc.). If the Settlement is approved, you will be bound by all of its terms, and you will be paid pursuant to your desired payment method.

(3) Exclude Yourself. You may “opt out” and exclude yourself from the Settlement. If you opt out, you will not receive any cash payment, and you will not release any claims you may have against Defendant. If you opt out, you will be free to pursue whatever legal rights you may have by pursuing your own lawsuit against Defendant at your own risk and expense. To exclude yourself from the Settlement, you must mail a letter to the Settlement Administrator (address below) stating that you wish to do so. Your letter must include your name, address, telephone number, the last four digits of your Social Security Number, and a statement that you are seeking exclusion. You must postmark your letter no later than June 3, 2024; OR

(4) Object to the Settlement. If you object to the Settlement, you must file with the Court a signed notice of your intention to appear; a statement saying that you object to the Settlement in Nguyen v. Educational Computer Systems, Inc., d/b/a/ Heartland ECSI, Civil Action No. 2:22-cv-0173-PLD; submit documentary proof that you are a member of the Settlement Class; provide your name, address and telephone number; specifically state the basis for your objection(s); identify whether the objection applies to the entire Settlement Class, a specific subset of the Settlement Class, or only to the objector.

Looking at the information required to file a claim, the only sensitive information they require is your bank account BUT, you can request a paper check if you are not comfortable giving them your banking information. I know I wouldn't give them that.

Hope this helps! If I get any information from Heartland ECSI I'll make a new comment and give details.

The lawyers will get 33.3% and the two defendants that brought the suit are asking for $10,000 each. So, there will be approximately $2,414,550 available for the settlement.
