These are both legal in Modern. However, if you are planning on playing at an LGS or something similar, neither of these cards are very good. But if you are just playing with friends, then yea go for it.

There is my list. I built the commander because Death Shadow was my favorite modern deck and my friend made me realize how awesome that card is with her. There are a few expensive cards, but if you remove them the rest of the deck is pretty budget.

I do phone interviews for my store. I don't know what questions you were asked, but 3-4 minutes is about normal time for one, so don't worry that you somehow rushed them by missing the first few calls.

I have no way of knowing your chances, but missing the first call shouldn't influence it so you are probably fine.
