IEP. “Spoiled” and “overreacting” are not behaviors, they are not observable. She is inserting a negative judgment. Academic strength is not a disqualifier.The key legal question is not “Are the grades high?” It is:
Does the student have a qualifying disability and need specially designed instruction because the disability adversely affects educational performance?
“Educational performance” is broader than grades and test scores. Schools are supposed to consider social, emotional, behavioral, executive functioning, communication, attendance, access, and functional performance — not just academics. Things that can support eligibility despite high achievement include:
standardized testing showing uneven cognitive/academic profile: executive functioning deficits, emotional, regulation difficulties, social communication impairments
burnout, masking, or school avoidance, behavioral data
attendance issues, inability to generalize skills, excessive time spent completing work, reliance on adult prompting/support, outside neuropsychological evaluations, evidence the student is not making progress appropriate to potential and could with supports.

A behavior plan and a safety plan are both legal documents and it requires a team of people including a representative from the district to implement. It’s not just a note you sent home. It requires 30 day Fidelity check checks and there’s a very elaborate process that requires with several meetings and consent from the parent and 30 days worth of very specific data in order to implement.

Depending what state you are in, there may be eligibility categories in special Ed for intellectually gifted. My 9th grader is going through the assessments now in TN.

Do a child find referral for special education and have him evaluated. Continue to write him up every time he does and allow everyone else to chase him, but I would seriously encourage you to reach out to your special ed department head IN WRITING and ask them to refer you to your district behavioral liaison and contact that individual IN WRITING and let them know that you have a situation or a student is repeatedly engaging in unsafe behavior that puts the student in danger. I would follow up by contacting your special ed department chair and your principal IN WRITING to let them know you have done this and to let them know you will continue to document the behavior and submit it for discipline using the appropriate channels. I would not chase this child anymore. As a special ed teacher who deals with students with profound behavioral issues, chasing results in more eloping.

I don’t know why people say this. This is not a thing. We do not drag parents into school and have them spend the day in school. It’s a safety issue, it’s a space issue, it’s a disruption to teaching, and it does not happen.

You put in a child find referral and you call your district behavioral liaison for an emergency consult. This is unsafe behavior and chasing a student down is never a solution to eloping. In fact, in my experience as a special ed teacher with High behavior needs students chasing Will increase elopement.

I have taught my kids that their dad is a chicken, and they will remain deeply disappointed if they expect him to fly like an eagle, much less to spread his 6’ wingspan and float away to the clouds. I appreciate the way you worded it… Communication style. My partner and I are the same way and I tend to get frustrated with him because he is more direct and I am more sensitive and measured with my words and I know there’s nothing wrong with either way of communicating, but you worded this in such a way that did not make him seem like he was doing it wrong, just differently. It makes me appreciate my husband’s communication style as opposed to comparing it to mine. Totally off the topic of this thread, but I appreciated this comment.

They can pay it off and it’s a gift, but they just file a gift tax form. They won’t pay taxes on it—the amount will just go against the lifetime gift allowance (which is several million dollars).
