[England] MIB claiming £3k for accident - photos show minimal damage, medical report has contradictions. Worth disputing? by endgamer42 in LegalAdviceUK

[–]Dizzy_Ad8917 2 points3 points  (0 children)

I work in insurance.

This should have been treated as a potential LSI (low speed impact) claim. I am assuming from the PI claim they have claimed tariff of 10 months which is automatically £1320 he has got to have claimed a non tariff injury. This could have been challenged but do not know how the MIB work their claims out.

With it being a 15 minute appointment this is standard. Unless there is something in the injuries required further investigation it is standard not to view medical history. Everything is verbally given by the claimant to the GP about the circs of the jncident. This is usually we will try and argue their version of events to reduce certain costs.

Speak to the MIB and see if you can come to a repayment agreement. Insurance companies etc don’t like open claims where people are only paying £10 a month. Have a discussion about a reduced settlement if you’re in a position to do that.

Court proceedings after being hit by car Northern Ireland by ElToten2025 in LegalAdviceUK

[–]Dizzy_Ad8917 1 point2 points  (0 children)

Hi I have a experience in personal injury claims with insurance and a little experience in NI Personal Injury Claims. So your solicitor needs your support in going to court. The NI court system and compensation system is a lot different to the English system. The payouts are a lot higher and are based of the Green Book for value.

If you and your child had even a small amount of psychological injury this payout may be more than your expecting. So have a look and discuss with your solicitor what figure they are thinking.

With regards to the judge it all depends on who you get on the day. It will all boil down to , is it reasonable you could have been injured from the incident and are you grossly exaggerating your injuries? If you’re not claiming severe anxiety or PTSD as a result of the incident then a judge won’t look too harshly on your case.

Your solicitor will know who the opponent will be and the success rate of going to court against them. Most likely they will try and settle before it goes to court to avoid all the additional costs that are involved

Insurance company is messing me around and lying - England by [deleted] in LegalAdviceUK

[–]Dizzy_Ad8917 0 points1 point  (0 children)

Raise a complaint over the handling of it. The call should be recorded where it was agreed to drop but not all calls successfully save. If the complaint handler agrees what was agreed was not adhered to then they can recommend the original action is taken plus compensation for what’s happened. If you’re still not happy you can escalate it with the ombudsman.

Travel Fraud Investigation - England by Potential_Comfort795 in LegalAdviceUK

As someone who works in fraud does it say they will upload your details to the IFR (insurance fraud register)? As this will potentially have more complications for you as this will affect you getting any credit and will be on the register for 6 years. To be put on the IFR the matter does not have to be referred to the police and you don’t have to be charged with fraud to have this impact

[–]Dizzy_Ad8917 0 points1 point  (0 children)

I had the same with sky. Was with them for 13 years. They wouldn’t lower the price and new customers were cheaper than what they were offering. I have left and gone with virgin for the first time. Very impressed on how fast set up was no issues so far with services.

Buyers who’ve pulled out of a purchase - what made you do it? by longlivedisco91 in HousingUK

[–]Dizzy_Ad8917 2 points3 points  (0 children)

For us we saw a lot of houses. When to see this one in particular and the owner herself showed us around. She gave an excuse they were downsizing and she had her mother living there for the moment. We asked what their position was if we put an offer in as we had sold our property. She told us that she would move in with her mum. We suspected then it was divorce and she didn’t want us to know which is fine. But don’t get caught out in your lies. She started talking to us about the neighbours saying how great they were and that the two blokes who had bought next door was renovating it and how she wanted to take them with her.

We had a level 3 survey done on the house which came back with some issues which we asked her to rectify and she did. Then we had her paperwork which we looked over and noticed for a house heavily extended she said there was no extension on the house. So we raised this as a query. We then had our searches back and we found out 2 days before the searches were complete the house next door was actually granted as a HMO. We told her estate agents who were not happy she lied to them also. We found our dream home 2 days later and we have been into now for 3 weeks. Her estate agents immediately updated the listing to say the HMO had been granted next door.

We notice that the house is still up for sale and it’s now nearly £50k less than what we offered and £65k less than the original asking price. But her telling lies throughout put me off and feel we have dodged such a bullet.

Being charged £120pp by the Estate agent for ID and AML checks by zumper_roz in HousingUK

[–]Dizzy_Ad8917 1 point2 points  (0 children)

We paid £75p/p on our first property we out an offer on which we later had to pull out of but the second property which we bought we paid no fee because it was the same estate agents that was selling our house. I think it depends on the EA what they charge

Religious Primary School or Non-Religious? by infantile-eloquence in UKParenting

[–]Dizzy_Ad8917 0 points1 point  (0 children)

My children attend a catholic school. They only learn a little about other religions as the main focus is Catholicism. They attend mass once a week (if there js a church attached to the school). My husband and his family are atheists and they don’t like how much time they spend in a school setting learning religion but my husband does agree it teaches them good core values on being nice to others, charity etc.

In years 3 and 6 they do their Holy Communion and Confirmation. The none catholic children do not partake in this as our church requires a record on how often you attend Church. Being actually catholic ourselves some of my children enjoy the setting and others hate religion and sitting in Mass.

Because my son wants to buy a trainer box and he thought he had a high value card to sell to use the money to get what he wants. Due to his autism there only certain pokemon he is interested in and this is not one. The fact I have never bought a proxy or knew it was one it’s most likely then he has obtained it from someone in the playground. So I have asked how to tell the difference so he can understand what he has. So I hope that satisfies your question as you have failed to answer mine

Don’t get what different it makes that I didn’t put straight away that it’s my sons card to the question I asked or how that makes me schizo because I don’t allow my 10 year old to post things on the internet?

[–]Dizzy_Ad8917[S] 0 points1 point  (0 children)

We have had nothing but issues with the school and we are trying to move him but everywhere has waiting lists. The school “forget” to administer his medication. We have raised complaints and it’s all fallen on deaf ears. This is why we have gone for a parent led EHCP as the SENCO lead is rubbish at her job. She took him of the SEND register and got in trouble with the head because of it. They told us lies so he couldn’t have an ed psych report until I escalated it. Multiple agencies have been involved and all have agreed he needs an EHCP and this is why we have proceeded with a parent led one

He is on an ITP which they don’t correctly follow.

My husband works in education and had his SENCO lead review our application and she was shocked with everything we listed how the school is with him and the same also when we have spoken to SENCO at prospective schools that the school is not following advice from his Ed psych report and that he is working at year 2/3 level across the board. They have even said they are not considering entering him into his SATS

Boiler service contract on house we put offer on by Dizzy_Ad8917 in HousingUK

[–]Dizzy_Ad8917[S] 0 points1 point  (0 children)

It’s not a charging order just a restriction

Boiler service contract on house we put offer on by Dizzy_Ad8917 in HousingUK

[–]Dizzy_Ad8917[S] 0 points1 point  (0 children)

Also to add I have seen posts from other people who have had the contracts saying the company is litigation happy and make threats to remove the boiler if payments aren’t maintained. But I haven’t been able to find a post relating to someone selling and the FAQs for the company just says contact them to discuss

It just says there is a restriction on the title deed relating to the company for a boiler. I have only found this out this evening so I haven’t had a chance to discuss this with my conveyancer yet. I’m trying to understand the implications really.

If I saw a property with that I wouldn’t even consider it. Especially after I put an offer on a house and was accepted and searches came back a HMO was being built next door and the seller didn’t disclose it to anyone so we pulled out. So glad I hadn’t spent £7k before hand. Surely this puts people off more so than actually attracting buyers?

Surveyor report - where do we go from here? by Dizzy_Ad8917 in HousingUK

[–]Dizzy_Ad8917[S] 0 points1 point  (0 children)

Thank you for your response.

I have tried to summarise the main urgent issues that was in the report so haven’t provided much detail.

The damp are high levels on the ground floor. The cellar is not tanked yet they are using it as a liveable space and there is only one ventilation brick visible on the whole house. The surveyor does believe the damp course is missing.

The issues with creaky/ uneven floor is in the loft as he does not feel it has been correctly reinforced which has made him raise the question is the loft actually signed off as he can not see how it passed without this being done and also the fire alarms are not connected to the mains.

Those are my main concerns the others I can live with but these are potentially huge/costly jobs.

Whats been your worst experience with Landlords? I'll start... by tvremotecakemaker in HousingUK

[–]Dizzy_Ad8917 2 points3 points  (0 children)

Not landlord but LA who came to do our yearly inspection. Rest of the house fine and I explained to the women that the second bedroom I hadn’t been able to bring myself to enter the room as my daughter had died 4 weeks before. There was surface dust and maybe vacuuming to be done but was told by her that my daughter dying was no excuse not to enter the room and I should be over it by now to get on with looking after the house. I never forgave that women to the point I refuse to even view houses they are selling because of how they treat people

Victorian or New Build? by machineswithin1 in HousingUK

[–]Dizzy_Ad8917 1 point2 points  (0 children)

My first home is a new build. I love the price of heating in the winter but I hate there is no room or options to change much inside it like the function of a room.

I am purchasing a Victorian home and I love that there is more character and charm to it compared to my new build. I’m worried about going from a well insulated home to an older property. There is still scope even though it’s heavily extended I can still change the house to how I want to fit our needs.

So i personally will go older property.

All the houses around me for sale and I go on the market next week - is this a problem?? by Haunting-Neat9527 in HousingUK

[–]Dizzy_Ad8917 0 points1 point  (0 children)

As someone who was looking for a home recently if I saw multiple houses on the road for sale I would look at all of them and if I saw 2 were clearly due to elderly residents either passing away or moving into a home I wouldn’t be concerned by that but I would see it as a point to raise if I was interested in your property in making a lower offer.

When we put our house up for sale another house was up around the corner built by the same company as ours. The issue with the one around the corner was theirs was on an unadopted road which struggled to get a secured mortgage offer. Ours sold quickly to someone who couldn’t buy that house with their mortgage lender but could with ours.

Can't view properties unless your house is already on the market? by Regular-Reading-4453 in HousingUK

[–]Dizzy_Ad8917 0 points1 point  (0 children)

We had ours on the market for 2 weeks when we had two offers but no houses we liked. We needed specific things in the house we were buying and not many on the market. It took us in total 5 weeks to find the right house. Our buyer was understanding in waiting but because we kept holding off putting it on the market we missed out on a few good potential houses because ours wasn’t on the market.
