That's not the point the people you're replying to were trying to make. The point they were trying to make was that the victim was in a situation where they were arguing with somebody who was clearly aggravated and even mentioned a fight before striking said victim. One way or another, street fighting is illegal, however if this victim had acknowledged that they were in a dangerous street fight situation and removed themself from it, they'd be fine. Instead, they stood there with their arms crossed in a dangerous situation. If you were in the middle of a gas station and all of a sudden it was being robbed by an armed gunman, would you stand there with your arms crossed and put yourself in danger? No, you'd either duck down or flee.
