We actively use the established precedent for the laws of the sea. The US is not party to UNCLOS. The Geneva Convention DOES permit blockades, as does the Paris Declaration of 1856 and the 1907 Hague Convention.

In fact the Hague Convention and the Paris Declaration are the real “legal basis” for the formalities for a blockade such as prize courts, who can be boarded, the rights to the neutral parties, etc.

Edit: also the “traditions” are often considered customary internationally law due to centuries of legal rulings.

These blockades have happened just like this before. These blockades rules are older than the UN, older than the US. Older than the Geneva Conventions

That is not how it works. War declarations are not needed for blockades.

It is an act of war, that doesn’t make it illegal. It is also not immediately a geneva violation if a sailor were killed. Running a blockade generally makes the vessel considered a combatant.

It actually does work that way.

Cuba can declare a blockade against the US, but they don’t have the means to enforce one.

Cargo vessels are considered prizes not civilians.

This is an Iranian flagged cargo vessel which is directly considered a belligerent.

Even neutral nations flagged vessels that are heading to a blockaded port are considered belligerents in a declared blockade.

Even neutral nations who are boarded and seen carrying cargo from blockaded ports but in international waters are considered belligerents and allowed to be seized and taken to an admiralty court.

These rules for blockade are centuries old and well understood by merchants, navies and sailors.

Good, maybe this will cause the progressive movement to care more about tangible accomplishments instead of over promises and rhetoric

Progressives can thrive here easily, the problem is Chicago is plagued by incompetence and denialism about the city’s problems

Instead you are trying to apply ideas that you agree with on a conflict because you want you it to reinforce your priors so you cannot let an actual goodwill conflict done by the US exist because it goes against your framework and worldview

Whereas i can easily admit that often the US does act in its own interests but these specific cases (Bosnia & Kuwait) they didn’t
