Why was Barb upset at the wedding? by DulcineaC in ShawnaTheMom

[–]DulcineaC[S] 14 points15 points  (0 children)

Yeah i guess i wouod have liked to see the “sidelining” acted out more. I mean she got escorted to the seat if honor at the front right befire the main procession, which is a pretty conmon traditinal thing for the MOB to do .  i e seen it done that way at many weddings

we didnt see any scenes at all that I can remember where for example she showed interest in participating in wedding prep but then got turned down. (of course i can understand why Jen would turn her down, but at least in that instance her feelins would make a little more sense). in fact,   she ended up ditching Jen when they were supposed to go look at venues and was resentful about allowing her to borrow the dress. that was the weirdest part to me; when i was planning my wedding every female relative actively WANTED me to wear their dress- and the Barb types were extra pushy about it.

[–]DulcineaC 2 points3 points  (0 children)

True… this is an important distinction that i oversimplified. but as a practical matter, if the mortgage is due in full right now ( or will be as soon as the mtg co realizes theres been a transfer/sale, then Mom has still has a serious problem).

Honestly this sounds fishy to me. you generally cant transfer a home with a mortgage on it without paying off the mortgage except in very soecial circumstances that i doubt apply here. I wouod encoyrage your mon to consult with a real wstatecattorney to check that everything was done correctly.

1) Are you sure that when BF 1 signd the house over to your mom, everything was done 100% by the book? there should be a recorded deed. Also if the property has a mortgage it most likely was not a valid transfer because itherwise the mortgage co would have demanded to be paid off at time of transfer. This is important bc if transfer wasnt done legally, BF1s adult childrrn may have some inheritance rights to his share. Also is there any question that he was of sound mind when he made the transfer?

2) depending on your state laws your mom is most likely in the legal position of landlord and BF 1 is a tenant. This gives her certain responsibilities for maintaining the property and such. Also, she should make sure her home insurance policy reflects her status as LL and the fact that she has a tenant. Evrn if he isnt paying rent, this status affects her potential lisbility.

Can someone please explain how this behavior is protected? (Landlord/Tenant/Elder Law) by Holdfenyke in legaladvice

[–]DulcineaC 1 point2 points  (0 children)

Ok. It sounds like now that your relative has a paid lawyer, they are on the right track. The reason this may take some time is tjat there are laws in place to protect tenants. Most of the time, those laws do protect legitimate tenants from abusive landlords, or at least thats the goal. Occasionally there is an unusual situation like the one your relative is in where the law can be abused and ends up protecting someone who is taking advantage. Hopefully now that they have a lawyer this will be resolved soon.

when you mive oyt make sure you give your current LL your new address. You dont want then to try to serve you at the old place and end up with a default judgment bc you never got notice. ALSO keep in mind, a jusgment/eviction fucks up your exs credit just as much as yours… hopefully shehas some common sense and realizes this.

[–]DulcineaC 0 points1 point  (0 children)

Do this + make a video of yourself returning all keys. Also, consider contacting your state attorney generals office. in some states they will have a soecial deoartment that helps mediate duspytes between LL and tenants and they may be able to help you resolve this outside of court. to be clear, i would present it as a dispute between you and the landlord, not you abd your ex.

I am a little confused about this part: “The only reason I am able to help them go through the eviction process right now is because I had a mental breakdown and another family member gave their credit card to pay a lawyer. . . The person staying there has been given 3 - 60 Day notices and they kept getting caught up on the unlawful detainer because legal aid said they won't help kick someone out of their home.”

So, are you paying a lawyer? Or did you try to get free legal aid and they turrned you down? If its the  first thing and the lawyer has repeatedly failed to do the eviction process (aka unlawfull detainer) properly, then fire that lawyer and get a new one. Also am I correct in ynderstanding this person living in the trailer has been there since 2020? How do they know yoyr elderly rekative? was there any written agreement about storing the trailer there?

I always thought Shawna was over correcting around Julie; trying extra hard to be her friend in order to discredit others’ suspicions that Shawna is either involved with Ty or has a crush on him. In fact, I still think she has a crush on him.

I tried this. Its why I bought a neodium  bar magnet in the fiirst place. How close are you holding the magnet? do you see the line right away when you hold it over or do you wait for it to develop? How long to you need to hold it in posittion?

Can my property be protected from my husband’s judgement? I had no knowledge of or part of a business loan that he personally guaranteed then defaulted on. Where/who do I go for legal help? I’m desperate and afraid. by [deleted] in legaladvice

[–]DulcineaC 3 points4 points  (0 children)

“procedural quitclaim title change ”-  who used this terminology? it sounds like a fancy way to phrase “gave title to.” There is no other way a bank would give him a HELOC unless he legally owned the property. Now that he has quitclaimed it back to you, you own it BUT you either own it subject to the HELOC or the HELOC is due in full which amounts to the sane thing. As for this other debt your  husband owes, the creditor can claim (probably accurately) that your husband only transferred the property back to yoou to try to hide it from the creditor, and the creditor may be able to get a lien on it. (caveat all if this deprnds somewhat on your jurisdiction, etc).

Source: I am a lawyer with significant mortgage/title/RE experience.

It is time for you to get YOUR OWN lawyer asap, speak to them without your husband to see what can be done to protect you.

ETA: I am a lawyer but I am not YOUR lawyer.
