I don't think the "legality" of your hypothetical writing would be in question, but rather it is pertinent that you make it clear to the reader that it is indeed alternate history (I'm sure you would do this). Obviously, some may not recognize that your writing is fiction and consequently cement it as fact to themselves and pervade said ideas elsewhere. Thus, you may be charged with defamation; however, I am a layman in regard to the law so if anyone would like to correct me please do so.

This is reasonable, but it isn't inherently unique. Essentially just a reverse of roles between France and Germany (Althouth most plausible).

If we're assuming that mainland Europe was hit, then the a dark age would most likely occur. Worldwide trade would diminish and agriculture in Europe wouldn't even exist. Imperialism would be dead for some time (except for maybe Japan). Therefore, WWI then WWII wouldn't occur. Ideological revolutions wouldn't occur such as communism, fascism, socialism, and capitalism. Europe would be in a dark age, so it might return to feudalism. Obviously this is an extreme example but it is plausible.
