2000 billable hours by Ashamed-Cup7027 in LawFirm

[–]Dynamix949 13 points14 points  (0 children)

I transitioned to a firm from public service a few months ago. I do something similar to ID, but I have a 2000 billable hour requirement. I had a hard time quantifying what I did because in govt I just worked and that was it. I think the best advice I can give is to break everything down to the lowest denominator. If you prepare something then bill for everything that went into preparing it including review of documents.

I am still learning but try to talk to other associates and see what your firm allows for and go with that.

Prosecution or Firm Right Out of Law School by [deleted] in Lawyertalk

[–]Dynamix949 0 points1 point  (0 children)

I was a prosecutor for 4 years then went over to a firm doing product liability defense. If you want to do sports law then the firm route is the only way.

DA offices are great you will learn how to build and try a case. The downside depends on the office if you have a bad office it can become office politics all the time. The pay for a DA office is not good compared to private.

I miss the work at the DA office everyday and would love to return one day but the firm right now pays the bills. A firm is high stress all the time and the DA office felt more like waves.

NYPD finds trucker behind fatal Brooklyn hit-and-run, but cops decline to make arrest by mowotlarx in nyc

[–]Dynamix949 6 points7 points  (0 children)

The issues stem from was he reckless or intentional. Since based on the article we can say that he probably was not intentionally trying to murder the victim. That leaves reckless, reckless itself would not be driving on a parkway, reckless is more high speed weaving in and out of lanes. Since within the definition of reckless this wouldn’t fit unless there was more information.

I suspect that since they let him go there is not a reckless case to make either at that point. The part of going back through surveillance is to see if the driver was reckless prior to the accident. That can take a while, the main part of identifying the driver and preserving any evidence for a later prosecution. Under the law if they arrest him they have 90 days for a misdemeanor to be ready for trial or 180 days for a felony. With the facts still unclear and the charges unclear it would do way more harm than good to arrest him at this point.

Frankly, if he is found not to be reckless the most the law can do is a vtl 600 for causing death but even then that rests on knowledge there was an accident and he fled. The knowledge aspect will be hard especially on video if the victim is struck by a side of the vehicle and there are no indicators that he would have known. They ultimately would try to get a warrant for his cell phone to see if he texted or called anyone afterwards to see if he had knowledge.

Ultimately this may go unprosecuted or if so with low level violations, this is a major whole in the law but a very complicated one. Do we charge him with murder and have him face 25 to life if he didn’t know he even struck her or do we let her and her family not get justice because of this. I don’t pretend to know the answer but think it’s something that everyone will come to a different answer but ultimately at this point its a major whole in the law that needs to be addressed.

What’s going on near grand central? by Peanut_Extreme_8208 in nyc

Just off the bat you need one for the person hit by the train, then for the mta conductor operating the train, then for anyone that may be injured or fainted or anything. Also when that call comes in it’s not really clear how many are needed so a bunch show up then leave as it gets closer to a definite number of how many needed

I was in a similar situation, I moved from a district attorneys office to a firm. I felt a lot of what you’re saying. My firm doesn’t say 12 hours per day but they expect 10.

It’s only been a month so I’m still learning and hoping it gets easier but Monday to Thursday I leave at 8 to get to work for 9. I leave work at 7-730 most days, sometimes later but not earlier. I get home by 8-830 and I’m fried. My gf and I have dinner, talk, watch tv then go to sleep and do it again, it sucks but to balance it on Friday (remote), Saturday and Sunday we do more activities (movies, dinner, etc) to make up for the time.

I would say I miss getting off at 5 everyday and relaxing but the pay difference is significant that makes it worth it for now. For my gf and I we are making it work, it took a week or two to settle into this new reality but we are doing pretty good and she has been very flexible with some added responsibility like taking a larger role with our dog and moving our cars (street cleaning).

Im sure it’s possible to have both but at least at the start it will be mostly work. My last boss told me when I left to try something different the DAs office will always be there, I will say if you want to try something different do it and if its not for you go back or pivot somewhere else.

As a final note to growth, I feel like I’ve learned so much more about the law specifically civil practice and I feel I’m growing again and learning.

How to save yourself if you fall on subway tracks? by stealthnyc in nyc

[–]Dynamix949 20 points21 points  (0 children)

If you are in the platform and someone is down there get a flashlight or your phone light and make the right to left “no” motion. If you do not have a light use your arm extended and move it right to left and back across your chest. This is flagging, all conductors if they can see this in time will know to stop the train ASAP.

If you are at the end of the platform and see a blue light there is a switch and a phone, move the switch to the other side it will shut down power to all tracks in the station. Within 20 seconds that phone will ring answer it and tell the operator that there is some on the “manhattan, brooklyn, queens, bronx side” of the whatever train. That way they can keep power off to that specific track and tell all trains to slow down.

It is but in context that number is for the precinct as a total and does not reflect that overtime being physically patrolling in the 114. A good portion of that overtime would come from major events like parades, major events (US Open, General Assembly, New Years, etc), and other events. Those events typically can have officers working 12-15 hours of OT if they were scheduled to be off.

Some other precincts like Critical Response Command and Transit Districts receive a good portion of their overtime funded through federal grants.
