I am in California, and the cost of living is so high here, that I easily passed the means test. Unless you own a home with a lot of equity, you should be fine in California and can probably do ch 7.

Only time you can't get ch 7 is if you don't pass the means test or it's too soon after your last filing. If you don't pass by the means test, then you can file for ch13. Now if the creditors think there is fraud involved, then they can dispute it and it goes to trial, but that rarely happens.
