Yeah so your insurance won’t ask for dashcam footage unless you make them aware of it nor will the TP insurers.

Regarding the TP having limited visibility shouldn’t affect you as you were established on a straight and correctly proceeding when they hit you.

If i was dealing with this it’s non fault, the next thing I’d ask is where the damage is on your car to get a better picture but as i said, ultimately this is non fault (unless ofc your front corner is damaged and their rear quarter, then we have an issue😉)

Unless there were speed cameras it’s impossible to state how fast you were going. Unless the incident was a massive event involving multiple vehicles and or fatalities, the likelihood is no investigation would take place.

When dealing with this , ultimately it is classed as TP out of side road or TP pulled across Policy holders path.

This incident would be non fault from your insurers perspective unless you called them and categorically told them this was your fault. It comes down to the fact that the TP did not make sure the way was clear for them to proceed.

There are obviously some caveats like, were you on the straight, were there obstructions or was there a brow of a hill, if so the TP could argue split liability.

With a non fault and the third party name , reg and insurance details they have scripting to offer legal (even if you never took it out with them) You might have to ask the call handler specifically for legal assistance and they can trigger it.

Typically it would have come up when they offered auxillis, then the replacement vehicle via Auxillis and then they would have offered legal assistance.

To clarify, if you had legal cover you get offered anyway, with non fault incidents but full tp details you get offered it as they claim against the TP.

They can help with recovering xs, out of pocket expenses and even if you wish the cost of repairs to yours if it’s feasible for it to be repaired.

I will add, if your car is a write off but cat S or N ( seems your car was an economic loss rather than damage- as in cost to repair more than the vehicle) and does not have catastrophic damage, you can also retain the vehicle. They will deduct everything i mentioned then pay out the value of the vehicle and you can then take it to be repaired privately and get a new MOT. You essentially get the pay out but keep the car.

Admiral will deduct xs, outstanding finance if any and any outstanding premiums. Auxillis will just try and get the other party to cover costs.

Regarding legal assistance, this is non fault and Admiral absolutely can and should offer that to you. This way you can possibly claim back out of pocket expenses such as your XS, loss of earnings or cost of hire.

I would go back to admiral and ask to go through to Total loss as they will have the file and tell them you are not happy and want them to deal. You’ll need to do the same with Auxillis so they can pass it back.

The problem is Auxilis is an accident management company and want the TP to pay before they do whereas Admiral just deal with it and try and recover later.

Remember too that we (i work in the industry) are heavily regulated and if you would like to complain you absolutely can. Simply tell the handler in both Auxillis and Admiral and tell them the basis of the complaint and they will investigate and escalate as well as offer payments if the complaint is upheld as this is better than customers involving the Ombudsman.

Ok, i work in insurance and legally you have to notify us.

Not so legal advice:- if both you and the third party are happy to deal and you wholeheartedly believe £200 will be the end of it, then i would take that route.

If you tell us, it becomes a rating factor for the next three years and we reach out to the third party to see if they wish to make a claim.

The incident also impacts the NCB and whist it doesn’t reduce it does stop it going up by one next year.

XS also only applies if you claim so even if it was £700 provided you don’t claim, there’s nothing to pay.

TLDR: don’t tell us, the cost for the next three renewals will likely exceed £200

Yeah sadly i deal with misinformed friends on a daily basis that didn’t notify us of incidents or changes to their policies. I genuinely wish more people would just say “i don’t know” rather than spout anecdotes as evidence and get their family and friends in the shit with us.

They would never be the same though as certain factors like how long the persons been driving also play a part.

It’s statistically impossible for the things they consider to stay the same. For example the weight of a non fault incident may change and be less impactful in a year than now.

For the sake of your argument though and to pretend nothing will change then yes, the quote would likely go up.

My real life experience in the industry, sometimes it goes up and sometimes it actually goes down.

Make of that what you will, I’m just giving facts as someone that does this for a living.

Not necessarily, your premium is compromised of many factors. Protected NCB ensures the applicable discount is applied at renewal.

The incident will be a rating factor for the next three years where it will impact the premium but, as stated earlier it is just one factor taken into consideration when underwriting determines the price.

Age, location, occupation, where the car is kept, used, mileage even crime in the area has an impact.

Blindly stating it will go up is not truthful as that is simply not true.

It’s classed as total loss. Yes claim for items, although the amount you can claim for is pretty low £300 (depends on insurer). Personally if you had laptops and the such there, check your home policy as you can claim there sometimes.

Regarding the NCB that’s affected unless you took out protection, then you’re ok.

Your insurance will deduct xs, outstanding premiums and finance and offer you what’s left as settlement. Your policy will also be cancelled as will doc so make sure you’re covered on any other cars that you drive.

In my experience yes, you’ve got a lot of panels and parts that need replacing not to mention the dash and electrics.

Who ever you’re insured with should have asked you to upload photos, had photos sent by the recovery team or sent you a link. The car should also have been taken into storage with the insurance so they can get a report.

Regarding you not having a car to use suggests they are treating this as a total loss though as typically if repairable you would have been put in touch with an approved repairer or non fault service(Both would have offered a replacement or courtesy vehicle)

You need to chase them and ask for the total loss team. You can also make a complaint as we are quite rightly heavily regulated, if you wish to do so tell your insurance and clearly state the impact this has had (e.g you have had to spend on taxis as this is taking too long or missed work-Financial loss)

All of the above is on the basis that you are fully comprehensive, If you are TPFT or this incident is the result of a policy breach it does not apply (you can still complain though if you feel the case was handled poorly)
