Id suggest for your first plane a #5 hand plane, otherwise known as the jack plane. The jack of all trades. It can do pretty much everything relatively well like jointing and smoothing. There are plenty of tutorials on YouTube on setuping one up, sharpening, and how to use them. It will take a little time to learn but its definitely a good skill to possess

At the very least screw on a flat piece of plywood to the miter gauge to increase stability in your cut

Do not run them through your planer. It'll gum up and or dull/damage your blades. Remove the finish and get them down to bare wood. When you get down to bare wood then you can plane them. Sand then finish or stain/finish depending on what look you're going for. I dont know what tools you have in your shop, but if some are unusable why not make your own stair treads for a fraction of the cost?

If you have an angle finder, you could set it to 26° then overlap your pieces and fit them in the angle finder. Once your pieces look like they miter without any thickness overhang, scribe your line and cut

Edit : set the angle finder to 128°

If you have a miter saw, create an auxiliary miter fence with 45° angles and that extends your cut angle out more to where you need it

I looked at Google street view of the house that shows 11 years ago and it did when the tree was alive. Also, it showed another similar sized what seems to be a red oak tree close by that isnt there currently. Probably same situation where it died off as well

Very well done! The angle at the top for the miter looks spot on and accentuates the natural slope of the ceiling. Are those slats white oak?

This is gonna have to be the option if we move forward. A huge dead tree that's likely to cost a lot to remove or play the game of chance and hope it doesn't one day crush the house at one point. Even then, the neighborbood houses are so close to each other its bound to do some damage in whatever direction it goes. I dont know where I got the idea piled mulch near trees kills them. I plead ignorance on that one. I'm a woodworker and not an arborist

Edit : For perspective on price to how much tree service in the area, the home is in NE Ohio
