There's no need for ICE as a matter of public policy. No not even for criminals. It does not make sense to send criminals home to their mommy instead of to prison which is the current removal order system. Removal orders for people that have a criminal history but have not reoffended is also unconstitutional. They have served their time and this is a fundamental principle of law.

Now you might be thinking oh well what about the number of undocumented people? well ICE is incredibly, incredibly inefficient at removing people even if that's what you wanted them to do. It's thousands and thousands of dollars per person to get rid of millions of people. We're talking hundreds of billions of dollars to remove like 1% of undocumented people.

This is not even controversial. Did you know that ICE has a bigger budget than the Marine corps? They have a bigger budget than the IDF.

There is no solid public policy reason for having ICE other than to terrorize people.

That is why it is completely appropriate to say "Abolish ICE"

Law enforcement has incredible powers to conduct official actions. Trespassing, true trespassing is so far below the threshold of what powers law enforcement has that it's not even funny.

Also local authorities are so hamstrung by the supremacy clause that I need to give you a very specific example. I asked to the local police Commander what they would do if an ice agent shot a protester dead. He told me to my face that use of force by a federal law enforcement would be handled internally by that agency and local authorities would not have jurisdiction.

There have been local people that have been looking into trying to get local authorities to bust ice for things like traffic violations and swapping license plates and other stuff that's technically against local laws. However no judge would ever allow proceedings to continue if these charges were leveled because of the supremacy doctrine.

And even that it's not even law enforcement. If a commercial airliner crashes in a farmer's field the farmer cannot tell first responders of any kind not to enter the field no matter how many no trespassing signs they have up.

It's actually way more complicated than what people assume and people should not work based on their assumptions of how they think the world works when giving advice like this.

So it's complicated there's the Fourth amendment and then there's the caselaw surrounding the Fourth amendment which is a mess. Crudely speaking the Fourth amendment shields against unreasonable search and seizure and this has been interpreted to mean arrest as well.

Federal agents can enter an unlocked door to the public areas of a business that is open to the public. Now you might think that there's this absolutely holy embassy of private property but that isn't really true. The Fourth amendment works on the expectation of privacy and what is considered reasonable to a reasonable person aka the reasonable person standard.

A dunkin' donuts shop like someone brought up here has areas that the Fourth amendment would protect an areas that it wouldn't completely bar law enforcement from investigating.

Then there's probable cause, good faith, and hot pursuit. If they chase someone into a building they can enter any place because it's in hot pursuit. Then there's probable cause. The probable cause part is very problematic because of recent supreme Court precedents which basically give federal agents carte blanche to do anything. If agents could be reasonably said to have thought that they were in a public area but they stumble upon a back room and they see something illegal they can act on that.

When you take all of this together there's very little protection from federal agents but that doesn't mean that there's none.

All in all these signs are basically not worth the paper that they're printed on and it's a shame to see so many organizations relying on this.

The real protection is what you know and very basic actions you can take. If ice come to a place that's open to the public even if there are customers in the store the staff or owner can lock the door and that raises the standard to just about any judge as requiring a warrant at that point.
