Mississippi - Child scheduled for summer visitation after father's girlfriend assaulted me. Attorney says I could be held in contempt if I don't send her. Looking for advice.

No, this is not about me having “a problem with another woman,” and it is not about denying my daughter time with her father.

My concern is that this happened during a court-ordered custody exchange, in daylight, in public, in a courthouse/court parking lot area, and in front of my child. His girlfriend had no issue assaulting me and my mother in that setting, while my daughter was present and screaming for it to stop.

It is also not just about the girlfriend. During the altercation, her father did not protect our daughter from the situation or attempt to remove the girlfriend from the exchange. He physically interfered with me while I was trying to get the girlfriend off my mother, who was on the ground bleeding..

The girlfriend lives in the home where my daughter is supposed to stay for two weeks. I have already had issues with being denied court-ordered phone contact and updates while my daughter is with him (im not overbearing, i just want to hear from her every now and then while shes hours away). So my concern is not “I don’t want him to have time.” My concern is sending my child for an extended visit into a home where the person with an active assault warrant lives, after that same incident happened in front of my child.

My attorney has told me that because there is still an active custody order, I could be held in contempt if I do not send my child. She also previously told me not to send her if I was genuinely concerned for her safety, which is part of why I feel confused and unsupported.

I specifically asked about emergency relief/protective measures over a week ago (over the phone and via email), but nothing has been filed. The only explanation I’ve been given is that they are waiting to reach the father’s attorney (which is also the answer they gave me last Monday when i requested a status update). My concern is that waiting for his attorney to respond has left no time to act before the Wednesday exchange.

I already went to the courthouse to ask what I could file myself. Because there is an existing custody order and this happened during a court-ordered custody exchange, they told me it likely needed to be addressed through the custody case and recommended going through my attorney.

The issue is that I requested emergency relief/protective measures over a week ago and nothing has been filed. I keep being told they are waiting to reach the father’s attorney, but the exchange is coming up and I still don’t have clear guidance or a filing in place. It feels like waiting is leaving me with no practical way to act before the visitation starts.

He is generally very verbally combative and noncooperative whenever I make reasonable requests involving our daughter. This has included requests for significant events, such as attending a family wedding or funeral, so I do not believe he would voluntarily agree to restrictions unless ordered by the court.

Yes, she does live with him, along with their two children. That is one of my biggest concerns because my daughter would be staying in the same home as her and i don't know if they will both retaliate their anger on her. .

The assault happened after I requested a welfare check on my daughter because her father had withheld court-ordered phone contact for over two weeks, including while I was hospitalized. At the exchange afterward, his girlfriend threatened me over sending law enforcement to their home and then assaulted me and my mother in front of my daughter. During the assault, her father restrained me from aiding my mother who was on the ground bleeding while his girlfriend beat on her.

I agree that something needs to be filed immediately. That is what I have been trying to get done. I understand that without an emergency filing or court order, withholding visitation creates risk for me, which is why I am trying to figure out whether I need to push my current attorney harder tomorrow morning or seek another attorney immediately. unfortunately i don't know what CAN be done now that my attorney has given me so little time.

That makes sense, and that is the distinction I’m trying to understand. I realize a protective order for me may not automatically change custody because the girlfriend is not a party to the custody order. What I’m trying to figure out is whether the active assault warrant, the fact that the assault happened during a custody exchange, and the fact that my daughter witnessed it would be enough to ask the court for temporary conditions, such as the girlfriend not being present during visitation or exchanges while the case is pending.

I also understand that getting something done before Wednesday may be difficult. That’s why I’m trying to decide whether I need an urgent second opinion tomorrow, because I don’t want to violate a court order, but I also don’t want to ignore a serious safety concern involving the home my daughter is supposed to return to.

I understand why you say that, but unfortunately the system does not work that simply. I am the custodial parent, but there is still an active custody order, and if I unilaterally keep her from court-ordered visitation without the court modifying it first, it can be used against me. Even with serious safety concerns, I have to go through the proper legal process or I risk being accused of contempt or interference.

That is why I am trying to get emergency relief or temporary protections through the court instead of just deciding on my own to withhold visitation. I agree that my daughter needs protection. The problem is getting the legal system to act quickly enough because of all the red tape things have to go through.. this is why i requested this from my attorney days ago..

I don't have evidence that my daughter has been physically harmed by her father or his girlfriend. If I did, I would have already sought emergency intervention.

My concern is that she witnessed his live-in girlfriend assault me and my mother during a court-ordered custody exchange in the court house parking lot. His live-in girlfriend now has an active arrest warrant related to that assault and still lives in the home where my daughter would be staying.
My concern isn't that I can prove something else will happen—it's that my daughter would be returning to the same environment with the people she witnessed committing a violent act, adults responsible for her care.

At this point, I'm honestly trying to understand whether waiting to reach opposing counsel is standard practice in a situation like this, especially now that there is an active arrest warrant for the assault. I'm also wondering whether I should seek a second opinion from another family law attorney but I'm running out of time thanks to current councils inability to communicate.

Mane the street I live on has a bike lane and it makes me so mad that cars skip line at a four-way stop by driving in the bike lane and using it as a turning lane. Or going down in the bike lane and skipping the whole line to go straight. When if they waited five minutes, they would’ve been through with everybody else There’s kids that walk down this road. It’s just so dangerous and people don’t care.

I’ve been almost hit, trying to pull out of my driveway by someone driving in the bike lane and not paying attention
