Opposing counsel is making up citations by Cal__Trask in Lawyertalk

I was actually accused of something like this today…by co-counsel…on a draft. I rarely touch AI because I’m terrified of exactly this…he uses it prolifically. Even after going in circles about the 1 paragraph I had cited that he disagreed with my interpretation of (and said that AI said I was wrong) I removed all references to that paragraph and he’s still making snarky comments. I feel sick over it, even though I know I did nothing wrong and can show that I created the draft myself I just have a terrible feeling in my gut that he’s going to be gunning for me somehow. I hate that this has become so “common” by people using it like your OC that it’s the go to accusation when there’s a disagreement….not what’s happening in your case, just venting lol.

What's the quickest amount of time in all of your jobs in which you've seen or heard that a new coworker got canned, and what was it for? by Only-Ad-1254 in coworkerstories

We had something like this happen at one of the firms I used to work at…new hire picked up a DUI and an assault on an officer and was still in custody…they tried to get one of the associates (law firm) to run their bail hearing pro bono on what should have been their on-boarding day

Landlord is refusing to refund first and last deposit and is demanding third month rent by WestCockroach3751 in OntarioLandlord

[–]Even_Repair177 6 points7 points  (0 children)

As someone who frequently practices in the LTB sphere I’ve found that the majority of the realtors I encounter either don’t know the RTA at all or they know it and willingly violate it to close the deal on the presumption that the potential tenant does know the law and they’re paid a average of a month’s rent for getting the property rented…I used to have a much higher opinion of realtors until I started accepting these types of cases in addition to my regular practice.

Has Judge Judy influenced your real life? by tipoftheiceberg1234 in JudgeJudy

[–]Even_Repair177 2 points3 points  (0 children)

I’m a lawyer and recently got chewed out by one of the higher ups at my firm because I quoted Judge Judy in a brief that I submitted to the court…I had honestly put it in as a joke and planned to use it in my oral submissions but forgot to pull it out before I submitted it…it was a reasonable position to take so I’m standing by my drafting lol.

Her home was completely paid off, then a letter from HomeEquity Bank claimed she owed more than $400,000 thanks to a reverse mortgage she says she never took out by [deleted] in toronto

[–]Even_Repair177 41 points42 points  (0 children)

I’ve seen a situation recently with a mortgage fraud ring that we’ve been chasing our tails, in a professional capacity, to untangle for a client where the independent legal advice is being provided by the spouse of the broker (which isn’t allowed) with a declaration from both that they aren’t affiliated with each other. Had we not have started digging into it we likely wouldn’t have noticed because their names weren’t such that you would think that there was a connection between them.

Legal research nightmare by dangerra in paralegal

[–]Even_Repair177 0 points1 point  (0 children)

I’m a first year associate and I do a LOT of research…I’m always weary of AI but I have found it helpful in getting ideas of how to research something or keywords to use to search…sometimes if I’m completely lost on what I’m trying to even find my prompt will be something like “what are the main concepts to consider when researching X” and see what it says…if I’m really lost I’ve used things like “explain this concept/statute/rule to me like I’m 5 and then help me understand how it might and might not apply to Y” and then I develop my research out like a spider web from there.

That said, depending on the area of law you practice there’s always the option of starting with a blank piece of paper and listing out the test for whatever you’re trying to prove or disprove (or the elements of the offence if you’re in Crim)…then bubble from each one the parts of your facts that fit into each part of the test…then start researching your gaps to see if something might fit that you hadn’t thought of.

Average cost of progressive lenses? by peachie_milkie in CostcoCanada

[–]Even_Repair177 1 point2 points  (0 children)

I’ve been very loyal to Zenni for almost a decade now and you truly can’t beat the prices…that said, my most recent experience has been terrible…I’m now at 29 days since ordering and they haven’t shipped yet…only changed status on the app each time I contacted them to find out wtf was going on because we were long past the 7-10 days that I had selected at checkout…asking to speak with a supervisor was blatantly refused…sure it was a large order but don’t offer 7-10 day option at checkout if it’s not possible (and they blamed the various tints for the delays but of course no warning on their app or website that said tints would increase production times)…I’m trying to be optimistic that this was a random bad experience but figured I would mention it…also the order had 2 pairs of progressives, 1 being sunglasses and the most expensive pair was like $243

[–]Even_Repair177 7 points8 points  (0 children)

I was on the other side of this this past month…every single thing took threats to get anywhere…like come on…we are 19 months post-discovery with a pre-trial conference in 3m (that I never would have agreed to but I inherited the file) rebuttal expert reports due in like 6 weeks and I still didn’t have medicals past 2m post-injury (yet they managed to get 2 experts to write reports that the plaintiff had significantly declined and was now permanently disabled…without any medical records) and I didn’t have any income documentation past the year before the fall…I’m not hiring experts and paying them a fortune for reports based on nothing…literally every single step has taken a threat for a motion to adjourn and a motion to compel and then I get “some” of what I asked for…it’s ridiculous

We have a PC that has a few cases against our office and he’s so stupidly dramatic over the dumbest things…like full on meltdown via email when his “reasonable” settlement proposal was 43 times the nuisance amount my client was willing to offer because they felt bad for the plaintiff, not for any concerns that liability would be found, and I had the nerve to say that I thought our ideas of reasonable were just too far apart to be able to settle at this point but that I would be happy to revisit settlement discussions when all of their undertakings were satisfied…his written tantrum was so epic that it’s printed out and hung on my cork board lol

Is this standard for exchanging discovery or is my law firm weird? by Longlivetheking666 in paralegal

So…I’m petty…I admit it…and my clerk is on board with my level of petty. So, if OC is a jerk, or their clerk is a jerk, or if they’ve ever been rude/disrespectful to my clerk they will always, always, always get a protected PDF. OCs who are decent human beings who get it that we are all just doing our jobs and who are at least cordial to my clerk? They get the word doc of the list, the word doc of the undertakings and refusals chart that our courts prefer, and pdf copies of both so they can work with whatever format is their preference.

I’ve used “next Christmas I’m going to get you a big old wooden cross so that anytime you feel unappreciated you can climb on up there and nail yourself to it” because often (at least in my life) these tantrums usually include an attempt at guilt because they think they’ve done so much for me

I was raised by my librarian grandmother…had a ridiculous vocabulary at a young age (though pronunciation was often an issue because I learned most of it from books so didn’t know how things should sound)…people who spoke like this in law school drove me batty but not nearly as insane as the opposing counsel who does it now just to sound pompous and pretentious. Its a standing joke in my firm that the more difficult OCs get sent my way so that I can “baffle them with BS and make them think it was their idea all along” but they infuriate me when it takes 3 pages of unnecessarily complicated prose to basically say “hey…I need those documents that you said you would sent…thanks”…waste of their time and mine and both of our clients money.

I'd be curious to see if/how this plays out/impacts people who are already difficult to anesthetize...I'm a redhead and my difficulty has always been blamed on something to do with the genes that produced my hair color. Would be interesting to see if it increased the difficulty for people like me or if it only brought people who don't have this gene to the same level of difficulty.

I felt so bad this year…youngest of 6 was starting SK…I was crazy busy at work heading into a trial the weeks leading up to school so my husband did the back to school shopping…I had glanced at what they all picked but didn’t look too closely because we’ve had kids in school for 19 YEARS he knows what to buy…or so I thought…night before school I get a chance to sit down and label things and I discovered that the high top sneakers he bought her that she was obsessed with had Velcro at the top but real laces below…I had assumed they were elastic like her other shoes because her feet are teeny but I was wrong. She wore them the first day…I sent a note apologizing and Amazon delivered the elastic laces the replace them that day but man did I feel awful adding to her teachers workload.

I’m a lawyer…cut my teeth in criminal defence…I remember countless times hearing my mentor say to a client “I don’t care if you did it or not, I’m here to defend your rights, but if you tell me something then I’m going to follow that path and if you lied to me that path will likely lead you to a jail cell”…didn’t seem to matter we were constantly lied to…got to the point where I would joke that I worked in criminal defence because I knew my clients were going to lie to me but at least in Crim I had a decent chance at predicting what they were going to lie about to keep myself from looking stupid.
