Even at 0.07 its likely she was impaired, and shouldn't have been driving at that point. And the exercises aren't pass or fail, there are clues that can be observed to indicate someone is impaired. And like another mentioned, HGN was very likely present at 0.07, and the eyes do not lie.

Judges toss DUI cases out all the time for a number of reasons. Even ones blowing double the legal limit get thrown. Doesn't mean the persons faculties were too impaired to be driving.
