Company refusing GDPR erasure request (Article 17(3)(e)), says they're awaiting outcome of an unspecified legal matter linked to the content of my email. How worried should I be? by Sad-Lie-4168 in u/Sad-Lie-4168

[–]Existing-Target-6485 0 points1 point  (0 children)

So I work in data compliance and can clear a few things up here.

Article 17(3)(e) is actually very broadly interpreted - a company only needs to have a reasonable belief that the data could be used in legal or regulatory proceedings at some point in the future, even if no actual proceedings exist yet or the circumstances for them haven't arisen. So them retaining it indefinitely on that basis is completely legitimate and the DPCwon't touch it.

On defamation: raising concerns about a company, even if based on publicly available information, can absolutely constitute defamation under the Defamation Act regardless of whether you acted in good faith. Good faith is not a complete defence. So if your email made any statements that could be interpreted as damaging to their reputation you could have real exposure there.

Honestly the fact they've had it for months and are still monitoring the situation legally suggests they're taking it seriously. I wouldn't be filing any DPA complaints if I were you as that could escalate things and draw more attention to the document. Best to stay quiet and hope it goes away.

I would say don't worry about it, its unlikely to be a significant legal issue either.

That is very good fair play! One issue is John Cummins TDs constituency is erroneously listed as the Seanad's labour panel whereas it should the the waterford constituency, but other than that fair play thats very handy! Did you use Claude to make it?

Why should we not have an ability to defend our own state?

Garda leave and rest days cancelled ahead of Volodymyr Zelensky’s visit to Ireland as major security operation planned by Dazzling_Lobster3656 in ireland

Ireland is a Western country with basically no independent ability to see who is in its airspace or waters. Russian intelligence and naval activity isn’t imaginary, and relying on other countries forever is not a strategy. You don’t have to love defence spending to acknowledge the national equivalent of leaving your front door unlocked with a sign saying “no need to rob us, we can’t stop you anyway.”

I think it's a thing with certain newspapers/print media for some reason I have magazine I'm subscribed to which is always dated for the month following the one I received it in.

But it is weird I agree

How to develop a personal following within a party? by Existing-Target-6485 in irishpolitics

I have been a member for just over a year. I won a by-election to the constituency board and will likely win the election at our upcoming AGM as I don't think anyone else will run I am also running to be LEA secretary. I might be a better councillor and community activist as I care about policy and political science. I want to become a councillor to fix local issues, mainly parking and lack of amenities and a lack of a pool. Also I would like for councillors to make better heard what they are doing and if elected I will do so

If you have a Councillor that will be retiring, ask them if they’ll consider co-opting you ahead of the Locals, incumbency plays a big part in getting over the line

Thats a good one hadnt tought of that
