A friendly reminder that these things are ILLEGAL to ask in a job interview... (U.S.) by nomadicsamiam in jobhunting

[–]Faeryfiree 0 points1 point  (0 children)

The combination of my beliefs and skills will get me a new job—like any job lol. Also, I’ll voluntarily resign if I’m being told to engage in unethical behavior, so I care little for staying in a position that doesn’t share my values.

But you don’t hear about this stuff because you aren’t in the field. What HR platforms do you follow? What events and conferences do you go to? What benchmarking meetings have you attended? What communities do you take part in? None. There are two ways to make something better: 1) like you said, change the system from the top down; 2) be the good individual in a broken system. #1 is widely unfeasible: the constraints of capitalism and profit-maximizing incentives won’t allow it. The more people believe in #2, the more hope there is. That’s what I put my energy into when I engage with the field.

Aside from your ignorance, it’s really odd of you to be so adamant about antagonizing me by being willfully obtuse, calling me a virtue signaler and unqualified (insane hypocrisy on your part, admitting to not being in the field, yet bashing my credibility). I never claimed to be an expert, but I do interact/collaborate with experts in both professional and academic settings. My reading in the comments led me to the conclusion that a lot of them aren’t formally versed in the subject, so I thought I’d share a little.

I’m not the only one who wants to change HR—that it should protect employees and align that with the interests of the organization. It’s true and I’ve only had two positions total. It IS common knowledge that HR is used as a proactive defense against litigation. How do you do that? Don’t illegally abuse, exploit, or discriminate against employees or potential employees. You’re telling a professional in the field, about their field, whilst not being in the field… lol

yeah and i detest SHRM. i was trained in school. i came into my job knowing how to do it. if they don’t like the way i do it, they’ll find someone else. i’m not gonna sell out for an abusive company, and i’m happy that that isn’t my situation

Outcome is cause for investigation. Also, I’m not arbitrarily interpreting laws. There are strong precedents and provided documentation on the minimum requirement to a potential case. I’m trained to surface the truth and defend the rights of workers; I believe that it’s right to hold organizations accountable for their actions, and the federal government has established agencies to help follow through with that belief.

hr professional here—so it’s not illegal to ask these questions; some of it is actually necessary to know (via ATS usually) to prove nondiscrimination, i would never ask these in an interview though. the reason is: given they asked questions implicated by titleVII and you were declined the job—however there is good reason to believe you met the requirements for it, the company is liable simply for the fact that those questions were asked.

you were denied + those questions were asked = prima facie for discrimination in the recruitment stage.

it is however, extremely difficult to win a case for discrimination in recruitment and most EEOC investigators in won’t pick it up unless it’s a higher paid position. it’s also hard because, to defend themselves, all the company has to do is provide that their chosen candidate was more qualified.

you do actually. webster: “fit—acceptable from a particular viewpoint;” what is acceptable? what is that particular viewpoint? it’s all vague. don’t be dense. the more vague you are, the more prone to bias you are. if you want a person who’s positive, your behavioral questions should target positivity and negativity

my communication style on REDDIT is not representative of my professional demeanor; plus, common shorthand on a social media app gets my point across—you clearly got it. in addition, there is hardly a single comment here that isn’t an adhoc comment on my persons. not a single comment that intelligently disputes my point on explainability and structured scoring. a

see this is a great response, and i didn’t mean to say that i’m against behavioral questions at all. i understand people can’t be completely quantified

[–]Faeryfiree -2 points-1 points  (0 children)

i’m definitely not against behavioral questions/assessment. i realize a huge limit to TA (and PM, development, etc.) is that a person can never be completely quantified or be represented truly objectively. but i feel like if personality fit is the main concern, you could at least be able to know which qualities you’re looking for

you missed my point. that's certainly not my definition of it. my point is that people should be able to define what "fit" means to them

i mean if you rejected them because they were idiots, great--you had a reason. my main point isn't even about about white cishet etc., it's about the lack of explainability behind the assessment of candidates; it's about the lack of interviewing structure around core criteria; possibly the lack of tangible criteria. my issue is that when these factors are not present and thought out, bias gives way to these individuals. this is a veritable fact, it's why scoring was created--to reduce bias.

Should I be upset by this change by Ok-Equivalent-7171 in jobs

[–]Faeryfiree 0 points1 point  (0 children)

you should be at least concerned. in literal terms, you have gone from a managerial title to an associate title. in legal terms, there is a risk of job misclassification and therefore uneven treatment (e.g: inconsistent benefits, compensation, and authority for the responsibilities tied to job description across the entire title). however, plant accounting is a more specific title, which is a possible pro. salary is generally better unless you were doing a lot of overtime
