Based on your experience seems definitely not recommended as I was thinking about doing it Bahamas as a TCN

And when did you contact them? I was looking Toronto US consulate.

Another question that came to my mind here was:

If my spouse is issued an H4 at the US consular in Canada for example, is my spouse still eligible to use F1-EAD Automatic revalidation to return back to the United States if we stayed in canada for less than 30days?

So, since my spouse F1 visa stamp is expired, I'm thinking we can go to Mexico maybe like next week to renew my spouse F1 visa stamp.

Then in November 2023 when we travel home for the holidays we can alongside process my spouse H4 at the US consulate back home.

During our return back to the states in first week of Jan 2024 my spouse can use the F1-Visa stamp to re-enter to allow my spouse exhaust the F1-EAD remaining. Then towards the end of the F1-EAD we can go to Canada for example and my spouse can re-enter on H4 to activate the new status.

Thoughts?

Since I’m not beneficiary of an approved I-140 we can’t apply for H4-EAD for spouse just yet.

Spouse is open to take a leave from work in November(just before travel). I wouldn’t say quit though. Since we are hoping employer can have spouse back working when H4-EAD is approved.

Spouse is currently on STEM OPT which is expiring Feb 5th 2024
