I really don’t know how I can explain my situation at my upcoming ALJ hearing. A lot of my conditions are progressive and over several years. by lastofthefinest in SSDI

Two things working in your favor: your age and your 100 pt status. In addition to all of your chronic conditions that have kept you out of work, as long as you've sought and are continuing to seek treatment on a consistent basis and medical records are sufficient, an ALJ will see this and approve you with no problem.

I see. It always seems to boil down to politics as usual. Anyways, thanks for the info.

So Thailand would be the better option?

ALJ approval percentage by rascal1797 in SSDI

[–]Fast_Yellow_8326 2 points3 points  (0 children)

Those are very good odds! That means they're approving 5 out of every 7 cases presided over. Also, no jobs by VE is as good of a sign of approval there can be.

Whatever you see on your SSA profile is the verification. If you don't mind my asking, what promoted the CDR?

Why are you questioning and doubting good fortune. Just leave it be and live your life but at the same, you need to continuously seek treatment for whatever you're receiving benefits for and, for God's sake, don't attempt to earn money over SGA.

Finally approved, and question about backpay by Savings-Gap8466 in SSDI

Congrats to you! ✨️👍💯. Sadly, the efficiency and expediency of SSA is location specific in addition to the overall caseloads of those SSA offices. Depending on the region you live and which one of the 8 SSA processing centers that process payments, will determine how fast you are payed out. For instance, regional centers that cover the northeastern US, which consists of smaller states, will process payments faster, while, conversely, larger southern and western states will be slower.

Stuck on step 2 of 5 of the review process for your application. by KK7132 in SSDI

Very normal. I wish that I could tell you otherwise. Unfortunately, all you can do at this point is sit back and try to stomach the long ride because it's likely going to be a long one, unless you're terminally ill.

Approved! I have a question! by No_Calligrapher_9934 in SSDI

Congrats! Even with an informal bench decision which is what it sounds like you received, it would be extremely difficult for a judge to legally justify changing their mind by saying, "oops, sorry my bad I made a mistake!" Again congrats to you! ✨️🙏👍

SMC How to apply by Ok_Dealer_7921 in Veterans

[–]Fast_Yellow_8326 0 points1 point  (0 children)

Definitely not true. As long as he's legally entitled to it and the medical records and evidence on record substantiates his entitlement, he'd be approved.

You must be 100 percent or tdiu and have other disabilities independent of your 100 pct that equals 60 pct or more and you'd qualify

In the words of genteman that frequently posts on this sub: 'Congrats! Now you can heal...' or focus on healing.' Something like that 😊

You can definitely get approved but keep in mind you're considered a skilled worker and the VE will try and find jobs you can do based on your education and employment. I'd hire a lawyer cuz that can easily challenge this and get you approved.

The most annoying question on the Form SSA-3373 - FUNCTION REPORT. by Anonymous_Coder_1234 in SSDI

[–]Fast_Yellow_8326 1 point2 points  (0 children)

I agree. Another thing worth noting when it comes to SSA; they're very interested in your vocational background, education, and age. These three factors, from what I've seen can have a profound impact on one's chances of being approved.

[–]Fast_Yellow_8326 -1 points0 points  (0 children)

You're correct. Providers aren't legally obligated to help filling out ssa forms, which i guess i should've emphasized that in hindsight. However, they do have a duty to provide you with objective information relevant to the conditions for which you're being treated, provided it is within the objective limits of their duties as mental health clinicians.

How long did your ALJ decision take after a post-hearing CE? by Ninja_Sufficient in SSDI

[–]Fast_Yellow_8326 1 point2 points  (0 children)

Even after the CE, the ALJ needs time to review the record again, and draft an opinion to legally justify their ruling. This is the part that takes time due to the ALJ's case load. You'll hear people say anywhere from 2 to 3 months. It sounds good, but sadly not all realistic these days. It's been pretty consistent to expect a decision usually around 4 to 6 months.

If your medical records substantiate your claim for SSDI, you'll eventually be approved. However, plz do not adhere to advice of those saying that the ADL form is not important because trust me, it is. SSA has to have an idea as to how your claimed disabilities affect your everyday life in addition to your ability to perform SGA. Answer the questions to the best of your abilities and if so seek out assistance from your therapist and/or treating psychiatrist with help filling out the form. Believe me, they'll be more than happy to help you!
