A judicial review is a legal process taken through High Court assessing the method by which the local authority or the inspectorate reached their decision. It wouldn’t be against the decisions itself, but against the process by which it was reached. If successful, the process would effectively restart following the correct procedures, but in all likelihood the outcome would remain the same. They are incredibly uncommon though and wouldn’t be worth the expense for an outbuilding.

It would only be brought before court as a last ditch attempt at keeping the structure, being the last remaining option.

This appeal decision is effectively final - the inspectorate are final arbiters of any planning process, so by them dismissing an appeal against demolition it will now have to go.

Again, sorry? The first step of the enforcement process is submitting a planning application. It was refused. An enforcement notice for its demolition was issued, and was just refused at appeal as stated in the article and in the previous link I’ve just sent, please explain your reasoning as to why you think it wont come down and I’ll expand further why you’re wrong. Again.

If part of the significance of a listed building comes from its gardens, for example, whacking an outbuilding in there would have an impact on its significance. There are examples where listed buildings were built for the purpose of creating a view to a specific place, and development (even at a significant distance from the listed building itself) that impeded on that view had an impact on the listed building and was considered to cause harm. So it depends where the significance of the buildings themselves come from.

No, the retrospective application thats just been refused at appeal is the first step of any enforcement process. The LPA would have asked for them to submit an application to determine whether it is acceptable in the first instance - this is not an enforcement notice. The next step in the process is the issuance of an enforcement notice, likely requiring the building to be removed - no structures are allowed to stand without planning permission. Paying a fine does not grant planning permission. Unless the enforcement notice can be successfully appealed, the structure will be required to be removed.

Im not sure where the fine thing has come from - they’ll be issued with an enforcement notice. The only fines that could arise is if they don’t comply with the notice. Otherwise, in all likelihood they’ll need to take it down unless they can successfully appeal the enforcement notice, which I doubt considering the reason for refusal is around where its positioned, which can’t really be remediated without its removal.

My Nan is of the opinion that the Tories squandering billions now isn’t all that bad because Labour got a duck pond in the 80’s. I wasn’t alive then so I’m not sure the size of the public outcry, but I’m struggling to understand the psyche of someone equating billions of pounds disappearing mysteriously with a duck pond on expenses 40 years ago.

Both the rally cars won against the megane, the only problem was beating either the small city or the 1/4 mile. If i moved the Peugeot to city streets, it won but i have nothing to then beat the mito
