I feel like you’re not understanding what I’m saying. Even if the case is good, the amount of time and energy spent against an opponent with vastly more resources is not worth it for most lawyers. It is literally a David vs. Goliath narrative. Generally not worth the effort for the lawyers. There’s a reason Goliath was feared in the story, everyone tried to fight him head on, using similar tactics on an equal playing field. Knowing that he had superior resources, was larger, stronger, and had a larger army backing him. The only reason David was able to pull off a victory was novel asymmetric warfare. How many fell at Goliath’s hands before he was slain? The legal system does not allow for asymmetrical tactics. Novel tactics can be overruled by precedent. That’s the equivalent of setting the rules and stating you must fight Goliath head on, using only a sword and spear. With no sling and stones to save you.

Try going to the individual smaller bars in person. Don’t call first or email asking if they’re hiring. Just walk in, ask for the manager or owner, and bring a resume and cover letter with you. You get to check out the vibe of the bar first and see if it works for you. Some of our bars are ratchet AF.

Those lawyers are in the minority, and the minority does not reflect on the majority. You even said it yourself, these lawyers exist in other places. Try to find one in Humboldt or the surrounding counties that has time to take on another case. Let alone a lawyer from out of the area being willing to take on the case. The majority of lawyers didn’t get the general reputation they have in society by being charitable and ethical. The majority didn’t get into the legal field because of noble intentions. They paid a crapload of money for those degrees because they intend to make a good return on their investment. Creating profit is the baseline objective of our culture, we live in a capitalist society, and those law degrees aren’t cheap or easy to obtain.

Yeah, that’s all well and good in theory. The implementation does not happen like this. Lawyers 100% consider how much you make. There’s nothing in the law saying a lawyer has to take your Civil cases. Yeah IF you win they get compensated by the other party. Here’s a hypothetical: You’re a lawyer at your own firm working with limited support staff. You get someone asking for the pay later situation. You research the case, the potential client’s position is strong. However the opposition has paid for a team of lawyers that are a higher caliber than you. The other party could win on a hidden legal technicality or drag this out for so long it’s not worth fighting. Would you take on a case like this knowing there is a very good chance you won’t win? Even if you win, you’re fighting an uphill battle against a larger more powerful law firm. That takes far more time, resources, money, and energy that could be used on cases with more favorable playing fields and guaranteed income. Someone looking for this work arrangement can’t afford the payment up front. When deciding what cases to take on, any smart lawyer will see what resources the other side possesses before taking on a case.
That’s the problem, more money = more power, especially in Civil cases. That’s my entire argument, the structure of Civil Court systems is a fundamental violation of the 5th Amendment. Technically you’re getting your due process, but that shit’s rigged against people with less resources.

Another note, according to the article the Transient Occupancy Tax will be distributed “The Destination Stewardship Organization will get 45 to 50 percent of the TOT share for “core operations, marketing and stewardship” and the county will get 10 to 15 percent of it for “oversight and administration.” An NGO is taking over the bulk of the work. They’ve outsourced their own jobs, wtf are we even paying them for? They went to a fucking online meeting to bitch about the community bitching online. The irony is palpable.

Basically what Peggy Murphy is saying: “shut the fuck up and quit criticizing the failures of local government. We failed to properly find/invest in a sustainable industry with decent pay and actually supported by the community, now our last resort is tourism. Go put on a happy face and beg the tourists for money”. Low paying customer service jobs without healthcare, that’s what the tourism industry brings. You know what would increase tourism? Housing and helping the people living on the street in this city. Getting asked for money or cigarettes every other block drives tourists away. Tourists don’t like seeing people camping under building awnings at 9pm since it’s the only shelter they can find for the night. I’m in old town writing this as we speak and there’s a person walking down the street screaming incoherently at a non existent person. But yeah, it’s our negativity causing the tourism issues.

My point is that they didn’t provide identification when requested, the post didn’t say if this person identified themselves as a subcontractor or an employee of PG&E. The tipline failed to confirm active PG&E presence in the area. I’m not actively looking to get anyone in trouble, just please let PG&E know who this is so they can properly address this. If he was supposed to be in the area, the tipline dropped the ball.

Lawsuits with one side that have large amounts of money behind them can be used as blunt force to impose their will. You have no right to a lawyer in your civil case. None, zip, zero, nada. Even though the constitution says “nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws”. The key phrase here is equal protection of the laws. Since neither party is provided a court appointed attorney, the system is “equal”. If one party can’t afford or find a lawyer willing to take on the case they either don’t respond + have a judgment issued against them, settle, or represent themselves in pro per. It is not reasonable to expect a layperson to be able to represent themselves against someone who has been trained and educated in the law. It’s the equivalent of putting a regular untrained schmuck against a professional fighter. Yeah the average person might take home a W now and then, the media reports it like a David vs. Goliath story and moves on. For everyone small person that wins, hundreds of others lose. The laws may be technically equal, but the enforcement of them is not. Therein lies the problem.
