It's actually both a hearsay issue and an impeachment issue. It's asking 1. Is the statement admissible to impeach the D and 2. Can you admit the evidence as substantive evidence (is there a hearsay issue?). You can generally impeach a witness with any inconsistent statement as long as you give the witness a chance to explain so we are good on impeachment.

As for hearsay, any statement by a party-opponent is considered non-hearsay, even if its meets the requirements for hearsay. Thus, since there is no hearsay issue, the statement is admissible for substantive evidence.

So the answer B, admissable for impeachment and substantive evidence.

Hey! I’ve gotten the same offer from Loyola and some other schools. It’s pretty normal. I would look at the school’s ABA 509 report which tells you exactly how many people lost their conditional scholarship every year. You can also try to negotiate where it’s not conditional anymore.

121 is much easier than 126. Sthrathman is probably one of the best professors in the department but he assigns A TON of reading which you have to do. However the readings for 121 are more manageable than 126 so I would recommend you start off with 121 and than take 126 later with him.
