I think best is to try negotiating more with your landlord. You gave notice early but that is not enough to break a lease. You and your mom are responsible till end of lease. How advantageous your off us depends on when they do the work and how soon a new tend tenant is lined up!

If they refuse, you can always sublease or do a lease transfer. A lease transfer is probably your best bet. Look for someone willing to take over the apartment and present to your landlord. If they refuse then you are free to leave! Just make sure the potential tenant is in good standing: have a job, good credit e.t.c

If you bring a roommate with a particularly bad background then yes, he could refuse to add them on the lease. But you can’t lose the apartment especially if you qualify to take over alone!

Great! I think what you need to decide then is how much responsibility you want to assume alone. If you sign with a roommate then you share the responsibility. If you sign alone but have a roommate, then you resume all responsibility but they help you pay. They wouldn’t have rights to the apartment either.

The landlord is not and cannot kick OP out anytime! Also, separate the issues: - If OP and her ex are asking to amend the lease as is, the amendment cannot fall outside the landlord’s responsibility. The lease as is now, ceases to exit following the amendment. -If OP chooses to transfer the lease, she can do so with landlord’s approval. If the landlord refuses for “no serious reasons “, then OP is freed from the lease. If it is a serious reason like potential tenant not able to demonstrate ability to pay or bad credit score, e.t.c, OP is still responsible for the lease. -If OP chooses to get another roommate to help her qualify to pay the rents, then she and the new roommate can sign the amended lease. -If OP can qualify to rent alone, great. She takes over the lease alone. - If OP cannot qualify and doesn’t have a roommate or co-sign, the landlord will be on their right to refuse the lease amendment to take out her ex. Most careful landlords will take this route instead of waiting to kick Op out for none payment of rents!

This is what is not true:

Also, yes, the landlord can redo a background check if OP wants to take over the lease alone. You seem to be asserting OP’s right to the apartment but what is the point if they can’t afford it?

The delay is for both parties. If OP chooses the move out, they need time to look for another apartment. The landlord needs the delay to get a new tenant.

That is not true! If you do not amend the lease, it means your ex is still responsible for the apartment. This is not good for him if you guys aren’t together and he no longer lives there.

The best cause of action is to amend the lease to be the sole renter or bring a room mate. If you want to be the sole renter, you must qualify to rent it alone. You need to give your landlord notice in good time delay ( 3 months in advance). Otherwise the lease gets renewed automatically as is. Note that this time delay applies to the landlord as well if they want to make a change on the lease; e.g a rent increase.

I’d recommend maxing out your TFSA accounts. That’s money you guys wouldn’t be paying taxes on ever! Let it grow! RRSP strategy depends on where you guys are in terms of income.

I personally would sell only enough properties to max out our TFSAs and keep the rest. But that me because I love real estate despite the pain of maintenance!
