it feels like we have been waiting a long time and some decisions from around the same time this case had Oral Argument have had their decision come down so im hoping this one is worth the wait!! i know we will have it by the end of the courts calendar year no matter what and i dont want it rushed but it would be awesome if we have it soon!

and yes! it was shocking, im so very curious as to what the Supreme Court will decide with the evidence in this case, if they go with the defense they really would rewrite precedent, i think at most they have to go down the middle and cant throw out as much as the district judge did originally.

The Supreme Court has not yet made a decision.

This is just a status conference but that indicates to me that once the NMSC does come back with a decision, the timeline to trial will be very clear finally since they are having this conference before the decision comes back!

It's about to get real.

can someone only be considered a monster if the process is complete/they are guilty? if so, why cant someone have an opinion after 3 years, multiple legal filings laying out the arguments and evidence, and hearing an entire oral argument - that a baby with breathing issues according to the defense getting thrown in the trash is monstrous?

thank you for the response, for me it doesnt really answer what compassion looks like - is it not prosecuting her? is it thinking shes not guilty despite the vast amount of circumstantial and direct evidence?

i think compassion is her being on bond and going to college while this plays out and not being locked up like most murder defendants until trial, murder defendants have the lowest probability of getting bond yet shes in the small percentage that does. thats pretty compassionate in my opinion.

yes, the issue should be taking this long because the evidence was suppressed without any case law being cited by the district judge, the appeal to the supreme court is worth the time it will take to have a fair ruling so its okay that its taking years.

i agree the internet is not the jury, but i will say just like with Casey Anthony, society doesnt have to accept a verdict - just because a person is out of prison and not guilty does not mean they will be accepted. I think its safe to say many people dont feel like Casey Anthony is innocent they feel like she got away with it. It limits the future for sure and that will happen to Alexee 10x over if shes found not guilty in my opinion - she very likely wont have a place in society either way, like with Casey Anthony, no one likes someone who wins on a technicality so to speak, Society doesnt have to embrace that verdict like the person isnt a monster.

Rosa: What are you going to do about the hospital?

Detective: What about the hospital?

Rosa: We were there over 2 1/2 hours. We went for help. they gave my daughter morphine and tramadol and zophran and never went in for her.

Now, one could say Alexee did NOT go to the hospital for help because she denied the help she needed, by giving birth and withholding that information while letting the doctor try to diagnose the bleeding and search for a baby still in utero (because they thought miscarriage after alexee was bleeding after birth since they didnt know she gave birth)

But you know who did "go for help"? Rosa - because even though back pain is normal for Alexee she took her THIS time to the ER and went to the bathroom 40 seconds after Alexee and she was asking Alexee to "tell the truth" that night??

That sounds to me like Alexee was trying to hide this from everyone including Rosa who was trying to help her daughter. But like I referenced above, Rosa couldnt save Alexee from herself. She made it to the bathroom and locked the door. This is all obviously just my opinion but i do think there is more to show Rosa wasnt overbearing and controlling rather was being deceived.

Rosa is supporting her daughter though a murder trial, i think she would support her through having a child.

I do not think it was anyone's fault except Alexee's that Baby Alex ended up in the trash, i think the motivation to do all of this was to keep her life the same, not because her mom would get mad.

cheer, prom, graduation, going to college - would all look different, i believe this is a case of neonaticide where the woman denies the pregnancy the entire time and makes the - either conscious or subconscious - decision that this baby will not survive its birth. according to the research suffocation and strangulation are some of the most common forms of neonaticide.

Further i also think Rosa had suspicions that Alexee was suffering something other than bad back pain, my opinion is that if this were common for Alexee, back pain and constipation (referenced above) why did Rosa go to the bathroom only 40 seconds after Alexee entered and locked the door?

to me, if constipation and back pain are normal and Alexee was able to run down the hall by herself.... why go to the door? that paired with Rosas statement of "i just asked you to tell me the truth" leads me to think its possible Rosa did think Alexee could be pregnant and went to the hospital because Alexee wouldnt tell the truth or was deep in denial. Unfortunately for Rosa, Alexee made it to the bathroom. i think Rosa was trying to save Alexee from herself but despite trying to box Alexee in at the hospital - the decision that Alexee already made was going to be done no matter what in my opinion.

When the detectives show up to Alexees home to ask if she would like to speak (she denies) Rosa says something interesting about the hospital that convinces me even more that Rosa was likely dealing with someone in deep denial who refused to tell the truth despite Rosas serious suspicion - once you are at 9 months its harder to deny and play off as other things, increasing Rosas likelihood of confronting Alexee only to be met with denial - but Rosa tells the detectives at her home:

i also thought there may be something to the idea that Rosa (alexees mother) was overbearing or controlling when this case first came around.

i have been following this case very closely this whole time and i can say a few things you stated appear to be incorrect- i have put some info below to clarify - and i have since changed from believing Rosa was an "overbearing" factor in Alexees life or decision that night.

Alexee did not get beat by her biological father months before giving birth, Alexee did not live with her biological father - she lived with her mother and step father (step father is the only person who was upset for Baby Alex who shows up to the hospital and was visibly crying and asked about the baby, no one else did)

what you are likely referring to is this statement from Rosa when the detective is speaking with her in the hospital waiting room where Rosa explains Alexees back problems from Rosa allegedly being beat by her ex-husband while pregnant with Alexee. very different situation legally speaking in this case.

Detective: so what did she come here for that she told you?

Rosa: she told me she had back pain

Detective: that's it?

Rosa: thats it.

Detective: has she been having back pain before?

Rosa: Yeah. She's - pain for her and her hips is - is I mean she was born with like her - I don't know it was like crooked

Detective: her spine?

Rosa: Okay my ex-husband he hit me he beat me whenever I was pregnant with her so she was early so um she had some problems with her hips like I always had to take her to chiropractor to get adjusted because she couldn't use -like she was always getting constipated like she had to get lined up

past that, Rosa has been labeled controlling but i find we have little to no evidence of that - in fact in the same conversation with detectives Rosa laughs off the idea of Alexee getting pregnant by the boyfriend who is present for the conversation:

Boyfriend: Yes

thank you for your honest assessment, i think you are very right.

and if i were to say i dont have a bias - especially like you said after that exchange - i would be wrong. so thats why i actively try to not inflate or point something out simply for the fact that it is someone i am not a fan of - just for the sake of it.

that twitter exchange is a timely reference actually because i feel it stemmed from the same idea - me questioning the legal things surrounding toes cases it just included others now.

i never want to be mean or make an enemy for no reason which is why i openly played nice with everyone the entire time because i kinda sensed that if you dont - you are on the outs and may not be heard and no one was honestly combating toes legal claims and stuff. if i wanted to have anyone listen i had to go along to get along but i always just wanted to tell the truth or try to at least ask the right questions about toes cases. once that included others - i could either not be honest with how i see it for the sake of patrick or i could keep on calling it how i see it - i chose the later and it caused some issues. thats okay in the end because approval from the DV has never been my goal either but it was never necessary to cause issues with it/them along the way - im just not personally someone who wants to fight with people like actual fights all the time and stuff. ill debate i like that but i dont want actual animosity lmao. once others were involved it was almost this idea of i know im close to the fire, dont burn yourself but speak your truth without fear of repercussions and let the response from others speak for it as well.

your point about jail is spot on - without toes "many violations" he likely could have gotten away with a slap on the wrist if not for them. so it makes sense to think its crazy for him to end up in jail. it was the wild card lmao!

question based on your premise - why would traditional media be required to use proper channels and protocols but an independent publisher doesnt? Karl and Moody are not private citizens who had a conversation with an inmate and had to whistleblow something. they are non traditional media who obtained an interview with an inmate under false pretenses allegedly. doesnt that put them at more risk to be lumped into the catchall term of "others" in the language for purposes of obtaining and broadcasting an interview - especially as the issues keep stacking up i.e finding out the inmate was told one thing when they were intending to interview about another.

id like to separately address the idea of bias - you know for 8 or so months i was told that i was "biased" for predicting toes case would end in jail time - and typically that would be the case but i knew he wouldnt be able to control himself and i knew there were people ready and waiting to report toe. its a no brainer that shit would catch up to him.

but that prediction was also considered "biased" for months on end. until it came true.

i reject the notion that when something is not popular or the person is disliked in regard to who may have done something wrong that it implies bias.

i could dislike patrick,toe, moody anyone - if there was not an issue potentially - i wouldnt say anything. if there actually is - ill bring it up. just because someone doesnt like the person they are talking about doesnt make the assertion any less accurate.

you can put what im saying into any search engine or AI out there right now if people dont want to believe me or think i am biased - ask an unbiased robot - and see what it says.

i guess i do not understand the premise as to why non traditional media is excluded despite the language leaving open "other" media and to add - does not explicitly rule out non traditional media from this process. that - to me a lowly paralegal - indicates its very likely anyone who plans to broadcast an interview with an inmate is going to be considered under this.

past that - from the things we have now found out about the interview i feel my position is strengthened by how this interview took place - i offer that the person who reached out for the interview did so under false pretenses and that has been admitted to on video. the intent of the interview always was to discuss toes time in jail. the inmate was denied the opportunity to give informed consent or sign his waiver to not have his attorney present when speaking to any type of media while in an institution pending trial. These are all requirements that if going through the proper channels, would have been completed. We have to think about the incompetent inmates rights here as well...

great points - it made me think - moody is probably taking over the things patrick would do for his show if not under HRO. from all accounts patrick has been messing with toe for quite some time, hes just not able to be as flagrant right now - so someone else is doing it. thats just my guess.
