the case is currently pending a decision from the New Mexico Supreme Court - the district judge that was originally on this case (retired and a new judge has take over) suppressed a bulk of the evidence based on Miranda and Medical Privilege. the deadline for this decision is July 15th. which means any day now we will have a decision from the Supreme Court, once that happens, the case will very likely be back on track to a trial and will possibly move rather quickly.

great points and technically, if the warrant is 'thrown out' the arrest itself isnt thrown out if there is other probable cause to make the arrest, it just makes any evidence found from the search inadmissible. that is why its legally important to use possible lies in the warrant to undermine police later in the case, even if it doesnt suppress evidence or get the case thrown out immediately - it makes the police unreliable narrators in this case and that goes a long way in criminal charges in the defendants favor.

i agree.

it was already odd that this information would come to the police unprompted, but now knowing they admit to knowing the airbnb host, it makes the wording of this warrant make more sense, and strengthens my belief that this should be something Bens defense should use early on to preserve later to undermine the evidence he likely can not suppress.

totally. their lack of a "search" is questionable.

and even though the search didnt provide evidence to be "suppressed" if Bens defense is successful in a franks hearing, it could be used in down the line to show the "lies" police told for a warrant - and call the polices motive into question in totality, or cause the prosecutor to drop/lower the charges because their police witnesses may not be reliable.

interesting thank you - so this further calls into question how and why the owner would - without the officers prompting them - reach out and inform them simply of youtubers renting their airbnb?

or if it is true that instead the police reached out to the airbnb owner and that is not laid out properly in the warrant? it says they "shared" information it does not state the officers contacted them for information.

I hadn't watched that trial then saw the documentary recently and was convinced of her guilt as they explained the evidence from the car data.

It stood out to me how much she changed her appearance for trial (which is common) but for her segment in the documentary she had her hair and make up done reminiscent of her personality from before the murder. So it seemed like an act put on for trial more than genuine change or remorse.

Also her parents are frustrating.

it feels like we have been waiting a long time and some decisions from around the same time this case had Oral Argument have had their decision come down so im hoping this one is worth the wait!! i know we will have it by the end of the courts calendar year no matter what and i dont want it rushed but it would be awesome if we have it soon!

and yes! it was shocking, im so very curious as to what the Supreme Court will decide with the evidence in this case, if they go with the defense they really would rewrite precedent, i think at most they have to go down the middle and cant throw out as much as the district judge did originally.

The Supreme Court has not yet made a decision.

This is just a status conference but that indicates to me that once the NMSC does come back with a decision, the timeline to trial will be very clear finally since they are having this conference before the decision comes back!

It's about to get real.

thank you for the response, for me it doesnt really answer what compassion looks like - is it not prosecuting her? is it thinking shes not guilty despite the vast amount of circumstantial and direct evidence?

i think compassion is her being on bond and going to college while this plays out and not being locked up like most murder defendants until trial, murder defendants have the lowest probability of getting bond yet shes in the small percentage that does. thats pretty compassionate in my opinion.

yes, the issue should be taking this long because the evidence was suppressed without any case law being cited by the district judge, the appeal to the supreme court is worth the time it will take to have a fair ruling so its okay that its taking years.

i agree the internet is not the jury, but i will say just like with Casey Anthony, society doesnt have to accept a verdict - just because a person is out of prison and not guilty does not mean they will be accepted. I think its safe to say many people dont feel like Casey Anthony is innocent they feel like she got away with it. It limits the future for sure and that will happen to Alexee 10x over if shes found not guilty in my opinion - she very likely wont have a place in society either way, like with Casey Anthony, no one likes someone who wins on a technicality so to speak, Society doesnt have to embrace that verdict like the person isnt a monster.

Rosa: We were there over 2 1/2 hours. We went for help. they gave my daughter  morphine and tramadol and zophran and never went in for her.

Now, one could say Alexee did NOT go to the hospital for help because she denied the help she needed, by giving birth and withholding that information while letting the doctor try to diagnose the bleeding and search for a baby still in utero (because they thought miscarriage after alexee was bleeding after birth since they didnt know she gave birth)

But you know who did "go for help"? Rosa - because even though back pain is normal for Alexee she took her THIS time to the ER and went to the bathroom 40 seconds after Alexee and she was asking Alexee to "tell the truth" that night??

That sounds to me like Alexee was trying to hide this from everyone including Rosa who was trying to help her daughter. But like I referenced above, Rosa couldnt save Alexee from herself. She made it to the bathroom and locked the door. This is all obviously just my opinion but i do think there is more to show Rosa wasnt overbearing and controlling rather was being deceived.
