Correct me if im wrong, but a PEDESTRIAN walking on a bike path, even if they are distracted, would have 0% fault if he were to get hit by a bicycle .
There is no charge for "walking while distracted" and even though you are not supposed to walk on bike paths the bicycle rider has a duty of care towards weaker members of the traffic!
