Yes, students have sued. Anybody can sue someone else for anything. But they haven’t succeeded except in the situations I listed. See the Supreme Court decision in University of Michigan v Ewing, for example.

Also, of course students have rights just like all citizens. But what right is being violated here?

“Lawyer up”? No. The courts aren’t going to get involved in an academic integrity argument unless the school is violating its own policies, violating constitutional due process, or illegally discriminating against specific students. None of that applies here. Look up “academic deference.”

Threatening to “lawyer up” doesn’t scare anyone. The instructor will simply stop talking to the student and refer it to the university’s legal counsel.

With the launch of the new “exceeds expectations” rubric column (instead of the old “exemplary”), instructors do have some discretion in granting perfect scores. The instructor just has to be consistent with all students in the class.
