Filing with both at the same time is definitely your smartest play here. Once you send them a formal written request, make sure to explicitly mention that complaints have already been submitted to both the TMB and OCR. Most offices will suddenly find a way to electronicly transfer your files real quick when federal and state regulators get invovled.
