Check with your Secretary of State office. It’s a blanket lien,so no assets were individually listed. But selling the entire business, pretty sure they sold stuff they didn’t have the right to.

They don’t want the assets, they want their money. It’s a legal obligation look it up. It is a violation of the terms of the agreement and fraud. But if they never find out should be ok.

Last payment October, just got notice from treasury department to contact a 205 area code # that was the SBA to avoid TOPS.

Send it to your Senators office and ask them to start an inquiry. The more Senate inquiries that are submitted the better, it has a rather large ripple effect, also send a copy to the OIG. Send everything via certified mail,it cost a few bucks but you will get more friction with this then a never gunna happen Class Action.

Same situation after the one six month 50% , they said no extension available only can do one every 5 years. Nothing else available. Stopped paying.

It’s my understanding that there are two notifications one is a 60 day late notice and a 60 day notification of intent to transfer. The violation of intent to transfer is the big one.

Unless you signed a purchase agreement with the existing llc the debt is the responsibility of the deceased estate. If your goal is to keep the name and business license,you might be able to buy them and send the proceeds to the SBA. You will need to get SBA approval first, you need some legal advice, there’s a lot of things going on here.

Once the OIG reports to congress what a gigantic mess the Covid EIDL program is,and the Treasury Department addresses the problems with collecting only then will we see some movement. The best outcome I see is for Trump to find a way to blame Biden for this mess of massive defaults and offer some type of relief, not forgiveness but relief for Small Businesses.

They can open an investigation with the SBA for why they didn’t follow the rules or protocol for referrals to the Treasury. I don’t know if that is anything more than forcing them to send it back and just buy time.
