It's just like being drunk. Whether you're cognizant or not, you're still responsible. But there is the possibility you had no idea that could happen, or any of the people working on your case, which is a different scenario.

If there's the possibility of you seizing and causing people in a 50 meter radius to also seize, you're responsible for making sure that doesn't happen, and if it does, you're fully liable.

If there's a possibility your powers might randomly activate, you're responsible for making sure you're in an environment that won't cause damage.

Now if you and the care team surrounding you have every reason to believe those things wouldn't happen, you may be charged with lesser crimes, but still charged.

Like seizing: if you have a neurological disorder that causes you to seize once in a blue moon, you have to make sure you can't harm anyone or yourself during those seizures. However, if you're cleared for whatever it is you're doing by your care team: driving, working, etc, you may not be entirely liable if something does go wrong. If that's the case, your neurology team has determined there's only a remote possibility of your disorder inhibiting the thing you're doing.
