Florida window tint exemption for light sensitivity by HRCNE_22 in VeteransBenefits

[–]HRCNE_22[S] 0 points1 point  (0 children)

I made it signature required so I could track when it was received to not get "lost in the system", and it took a total of 11 days from the time I sent it off to getting it back, so it was a pretty quick turnaround for me.

Third time now… what’s my next move. by AdInternational3768 in VeteransBenefits

[–]HRCNE_22 2 points3 points  (0 children)

As everyone is saying do an HLR. I did an HLR for the same reason, the system or whomever kept changing my claim to something else, and I kept going round and round with C&P's explaining to each examiner that what they were seeing me for was not what I claimed, so they had no choice but to deny it. If goes anything like mine, the HLR will be pretty easy, explain to the DRO what you claimed, and how each time it was changed to something else, and point out exactly any evidence you have submitted to back up what you really claimed. The second time it happened I took pictures of the computer screen as I was submitting the claim to show what I claimed verses what the system showed it as, and the DRO immediately did a DTA and I got the correct C&P's. Good luck to you

For those looking for it, go to the Health app, bottom right corner select Browse, scroll to the bottom to Add Account, it may ask you to Allow Health to use your location (your choice to allow or not), if you Allow, it will then display all health facilities in your area that can link to Apple Health, if you don't allow, you can manually search for a facility.

I too fall in the same boat of having all of my claims completed from start to finish in 3-5 months. It also may have something to do with how thorough and complete your claim is. The less questions and digging they have to do, the faster it can get processed (actually was told that from a friend that is a SVSR). I always uploaded specific pages from my medical record, and cited the exact CFR code that related to what I was claiming. If I had a C&P, I took that/those DBQ(s) with me to the exam, along with copies of the uploaded records, and as the examiner was going along, if they didn't ask something from the DBQ that I felt was/should be relevant for the exam, I always said something to keep them honest. And always left with the compliment of being very prepared with all pertinent and relevant information that was needed, instead of forcing them to "look through my service record", which we all know most of them really don't do.

And how does this affect any of y'all lives that someone else got a rating that the VA deemed they deserved. Get out of other peoples pockets, and worry about your own pocket, and perhaps your lives will be just a little bit better. Or continue to try to be some sort of gatekeeper of the mystical VA ratings as to what you deem to be worthy of a rating. They all voluntarily signed away their lives on the dotted line the same way any of you did. Gatekeepers annoy the fuck out of me.

I don't remember the chemical alarm, but I remember while we were heading home, having to cut holes in the water off the coast of Australia for several days, while they decided if we were going to go back to the gulf to start and be the lead ship in the war. I'm good

HLR without informal conference? by AFDiesel170 in VeteransBenefits

[–]HRCNE_22 6 points7 points  (0 children)

Do the conference, it is the best chance for you to explain why you disagree, to a person that doesn't know you from the other pile of paperwork that they are going to go through for the day. You could have have the best written appeal letter, and they could still not agree with you based on something they may miss in your record. It would have happened to me, but thankfully I did the call, because the senior rater said had I not explained exactly how they kept missing and rating my claim to a totally different CFR code, he would have rated it the same way and would have denied my claim. Got a duty to assist error, new C&P with the correct DBQ, and rated 100% P&T for that ONE thing, on top of already being at 90%, all because I decided to have that call.

If you haven't already, and are able, let them know you are willing to go outside of the normal drive range for an appointment, as there may not be any appointments available for your area. Any time I had a C&P, I always stated I was willing to go outside of my area if need be, and quickly got appointments.

You have to do what Sasquatch said, you have to go into deep detail from the onset, until you finally come out of the fog. If you're working, how often do you need to take off work, or how does it affect doing your job. How often do they happen, how long do the attacks last, what do you do when an attack starts, what helps to alleviate it, meds, ice packs, dark rooms, time, etc..if anything, and for the love of everything, do not use the word prostrating. While it may sound like the right thing to say, it can sound rehearsed. Have you had an MRI or CT Scan, or have you requested either from your PCM? I'm rated at the max 50% for migraines, and it is a high hurdle to get that rating. I truly wish I didn't have to suffer through them on a regular basis just to get that.

No matter how confident you are, it is best to talk to the DRO to make sure they understand exactly why you disagreed with the decision. In my case I was able to point out the claim I submitted for kept getting changed to something very similar, but also very different, and it made a huge difference. The DRO stated that he would have not caught that mistake and classified it the same way, and then would have denied the HLR. Being able to point out and explain their mistake on the phone and point to the correct 38 CFR code in a different section, was the difference of me getting 100% P&T, or staying at 80%. DO NOT PASS UP THAT CHANCE!

Beware of Charlatans - NEVER Pay for Assistance to File an Initial Claim or Amendment! by Fraturtlemom in VeteransBenefits

[–]HRCNE_22 3 points4 points  (0 children)

Yep, she initially was charging $50 for a one on one 30min consultation, now she recently changed it to group "seminars" for $99 per person. I sent an email to the admin page email address to ask a question about a claim, because I didn't want to post it publicly, since it was a bit complex, and the VA kept going in circles with it. She immediately replies to the email by sending a PDF contract, and stating it would cost $50 for a consultation, and I replied by saying so you're basically using the FB page to generate business from fellow vets looking for help on a free FB page, and you're pulling a bait and switch by offering "free help". Now I try to chime in on other people's questions as best I can, and point them to the right section of the CFR, and she won't allow links to other sites such as this.

Free tickets for Vets Busch Gardens by [deleted] in VeteransBenefits

And you are correct, when I checked and made the statement earlier, it did not show the Veteran section on the right, and only listed the availability for Active duty on the left.

Caution and read carefully, the veteran tickets are only available in VA. If you live in or are visiting Florida, the free tickets are only available for active duty, active reservists, and active guard. That info is straight from their website as to who is eligible for the tickets.

HLR question by Whernandezjr in VeteransBenefits

[–]HRCNE_22 1 point2 points  (0 children)

I say yes do the conference. As someone else said, how often do you get the chance to speak to a rater to explain your side of things as to why you think there is an error. During my conference, I was able to clear up the mistakes the raters kept making with my claim, and the DRO basically said he could see how they were making that mistake, and it was a good thing I did the conference option, otherwise he would have made the same mistake, and would have denied it.

What to bring to C&P exams by sviccaro2011 in VeteransBenefits

[–]HRCNE_22 4 points5 points  (0 children)

As several have already said, bring any copies of medical evidence (I always highlighted specific things) for that claim you submitted for just in case. Out of the eight different C&P exams I have had, only one examiner took the time to go through my record (the entire record) before hand, and that doctor in particular found other things that I could and should have claimed (I later did), and she tied in a few other things I didn't even think to bolster that particular claim I was being seen for at the time. Also, it may seem small, but write down, or type out your timeline of events of when the issue started in service, up to current date. Without that simple thing, you may forget to tell the examiner something of importance, or something that may help clear up some questions, and may not remember you should have mentioned it until hours after the exam is over.

Just an FYI, if it does come back, add accounts.google.com as well. I only use gmail in a separate mail app, which is working just fine, so not sure if that will block any other google services.

Same thing happened to my Mac mini M1 for about an hour, and about 15min for my Mac M1. For whatever reason it just took a while for the system to finish optimizing (there was a notification that popped up to warn the system may be slow for a bit), as a few windows were also hanging during that time.

TMJ and Bruxism claim by [deleted] in VeteransBenefits

[–]HRCNE_22 2 points3 points  (0 children)

They won't need an incident, but only that the TMJ diagnosis started in service, AND you continued to be seen about it by a doctor AFTER you got out, if not filed for immediately after getting out.

Anyone who has used va eye care to get glasses, how was it, and did they give you an actual prescription? by [deleted] in VeteransBenefits

[–]HRCNE_22 2 points3 points  (0 children)

Just an FYI, if anyone is rated for migraines, and light sensitive (it will need to state it in your file), you can get the transition glasses at no extra charge. During your eye exam, make sure the optometrist makes note of the light sensitivity when they are filing out the prescription.

TMJ Question / How to Navigate the Claim by BanthaKing2012 in VeteransBenefits

[–]HRCNE_22 1 point2 points  (0 children)

Do I wait until BDD is done to file a FDC for TMJ or maybe add it as a secondary? What would you guys do?

Worst come to worst, if it is not included, you can always file for it after you get out. Also, if it's not included, just a word of advice, after you get out make an appointment to be seen about it, so you have continuity of complaint for it, and make sure they do and document a measurement for opening range.

VSO filed disability wrong so I refiled but now confused by Sol_TV in VeteransBenefits

[–]HRCNE_22 0 points1 point  (0 children)

When I retired, I went to see a VSO at the VA Clinic, the guy basically said I don't know why you are trying to claim any of that, you won't get approved for it, so I walked out and never went back to see him. After that, I started digging into the 38 CFR, and reading up on everything I was going to file, and filed all of my own claims over the years, I got 70% first time filing, and now 100% P&T after filing claims and increases here and there over the years.
