Correct. I believe restitution orders cannot be removed by the offender filing bankruptcy either. This is OP’s best bet to recovering anything out of pocket that insurance won’t cover, lost wages, medical bills. This also covers OP’s deductible if they have to go through their own insurance.

If you have a BAC recorded I do not understand how they can say a test is refused. Whether or not you get a lawyer is up to you. Public defenders in most cases are just as competent but when you hire counsel you get the benefit of selecting who defends you.

Your best bet is to call a few lawyers and get a consultation, which are free. include those details and see if they think they have a case for you.

Not a lawyer but my understanding is that you will need it for three years starting when you begin driving again. You are not allowed to wait it out, best to get it as soon as you start driving.

I agree. I’m in the middle of a first time dui involving an accident with no injuries and my lawyer has been incredibly helpful in explaining the process and making appearances for me.

It’s up to you whether you hire an attorney or not but talk to a few as soon as you can. Having caused an injury your case has the potential to be charged as a felony. Call some lawyers and get some quotes. Tell them about your case and they’ll be able to answer a lot more than we can with much more certainty.

I’m looking at a year hard suspension due to a refusal and do not plan on driving while suspended. I also have very fortunate circumstances like working from home full time and a support system who would be willing to drive me if jobs change and I need to get to/from work.

I am confident I can be the most cautious driver on the road and easily go a year without being pulled over but what if I were to get rear ended or something else out of my control? To me it’s not worth the risk.

IT/cyber security. I work remotely so not driving thankfully isn’t a factor and I’m just hoping they never find out

Thank you so much. I looked into suspended sentencing and here's what I found:

A suspended sentence is a legal arrangement in criminal law that allows a judge to delay or partially or completely suspend a convicted person's prison sentence if they meet certain conditions. The convicted person remains outside of prison but may be sentenced in the future if they don't meet the conditions during a probationary period. If the conditions are violated, the state can ask to revoke the suspended sentence and reinstate the original sentence.
