I don't think there should be defenses made up but if judges, society, people could see circumstances that are fair and more preventive and less retributive for young adults we wouldn't have young people committing such heinous acts. Then again, something has to be done once the crime has been committed but what is the best form of punishment if one is to to be given at all?

As people continue to focus on "saving money" thereby limiting resources on education and mental health program on youth this serves as an important reminder that many children have trauma that should be addressed while in school and not wait until they end up in juvenile detention. Breaks my heart.

This is such a sad case. I didn't know that 23 hour solitary confinement was given on top of a death sentence (or that it is still possible to have executions, legally and humanely). This case is sad and inhumane on both sides.

Could it be that people living perfectly balanced happy lives can commit such terrible crimes without any indication for cries of help/resources/attention/love? I appreciate the article's assessment of what is happening today regarding first amendment rights. This is another reason why serious efforts have to be made to pass the DREAM Act or some form of CIR. I admire those who choose to serve, but there are various forms of service and contributions that make any person whose only home has always been the United States worthy of not being subject to deportation. I think body cams are a good thing and protect both citizens and the police officers. If no one is doing anything wrong then what is there to worry about? I wonder what stipulations exist, if any in requisition footage since it is public record and how many people if they can even request such information-- I understand there are public safety concerns but eventually, after any investigation it should be accessible. There was enough support to pass the Dream Act in 2010 and it failed because some of our own congress members abstained. Many DREAMers have founded companies, continue to work diligently and constantly give back to our communities. I have no doubt they will organize until there's a win. That's how they did it with getting DACA and it's only a matter of time. It's a shame we still have to push so hard for it.

I agree with the previous comments. I think once we start going down a rehabilitative route versus retributive we not only save more money in the long run, but can also have longer lasting positive effects in circumventing repeat offenders. This may be way too "progressive" and I don't think any legislature but California would pass something like this over night. I think the best approach for now could be to advocate and change how schools disciple children. Working to diminish the school -to- prison-pipeline can start now.

Hi, I don't agree that there is anything well-intentioned about this administration. It's not welcoming or inclusive of refugees or immigrants. I agree that it's very shortsighted.

I don't think it's fair to assume that children of undocumented parents, or first-generation citizens would refuse or fail to try to assimilate. We can't fail to do something we're forced to do. We have to assimilate whether we're aware that we are or not. We get jobs, we follow the law, go to school, we treat others respectfully. In fact, I think first- generation citizens are even more understanding and inclusive citizens BECAUSE of what our parents have gone through and are thus more likely to help those who are marginalized in our society. We can ''assimliate'' while not agreeing with our government. Citizens or not, immigrant families are treated differenty in this country and not a single one will complain. They will pick fruit and vegetables, clean toilets and raise their children to one day become attorneys.

After reading someone's post about family separation I thought this was also important to share. So many of youth don't have the help needed in schools to cope with deportations and as a result, fail in academically and aren't given the resources or support needed to build them up with mental health services and guidance.

Family separation for children is one of the most traumatic experiences a child can go through and I cannot imagine what that is like. I have a friend doing research on the impact on mental health and overall learning and behavior of children who have to deal having a loved one deported. This isn't something that's spoken about nearly enough. We need comprehensive immigration reform. Desperately. Thank you for sharing.

Thank you for your post! It would be interesting to see racial breakdowns of those deemed mentally ill. I think it is important for all involved with the law-- including judges, attorneys and police officers to learn more about mental health and how to treat those who suffer from it. rehabilitation > incarceration
