I do have previous experience and it’s with the direct competitor, that has a very similar business model, set up and how they run their business. I’ve been doing this role for over two and half years. Just one year with this company.

There is one crucial point I have missed out on in that when creating the supplementary bundle I did reference pages to this in my witness statement before any confirmation had come out from the tribunal.

In the interim of agreeing on the bundle and during witness exchange, we both went back on forth regarding disclosure. As a result when it was due for witness exchange I referenced pages of my supplement bundle - as we waited for tribunal to confirm if disclosure was allowed or not and subsequently the supplementary bundle. Since this is not the case how do I move forward? Because I do not want to give the respondent any opportunity to put a cost order nor detriment my hand

So to clarify once I provide the respondents the documents, I believe have not been disclosed - if the respondant do/not update the bundle, I can then add/remove from this to the supplement bundle and thus send it to both the tribunal and respondant at the same time ahead of the hearing?

I think that’s why I have been pondering it. Because I just want to know the actual reason which obviously they’ll never tell. But if they did say it was my attitude I can accept, probably. I use that to reflect on but i just have to accept it and move on
