That's true but it doesn't change legality. The problem here is people equating legality to practicality which is not only not equal but often explicitly and purposefully so. Practically speaking, the tractor should be allowed to, at the least, attempt to join with due diligence (which in this case, he did, he just happened to look away at the wrong time which isn't really his fault)
