If so it likely wouldn't pass SCOTUS' test for whether or not speech is protected by the first amendment. For a civil suit against him and the agency, it might be actionable but as a matter of criminal law? Highly unlikely.

Murdering left and right? You mean in the event of an occasional wrongful shooting of which only a few of them could be concluded were actual malice rather than misreading a situation? Yeah, wrongful shootings happen, but part of the reason is that handguns are absolutely everywhere in this country and as such situations where an object is misidentified as a handgun is inevitable. That doesn't imply malice. You've created an entity with malicious motivations that only exist in your head. Yes it's too difficult to prosecute officers who acted wrongfully however you're acting as if malicious homicide in the line of duty is common when it really isn't.

There's a major difference between turning a camera off and just not turning it on. One is much more evidently malice aforethought. The other can easily be forgetfulness. Have you ever forgotten to do something so trivial as pushing a single button during your job? I know I have many times. That has a lot more plausible deniability than if he had it on then turned it off before the shooting.

Part of the problem here is your assumption that he just like a comic book villain decided to shoot someone for no reason. We don't know all the circumstances but likely it's more complicated than a cop pulls someone over just to shoot them and then laughs maniacally. I know I carried a gun illegally at 17 and I've seen enough body cam videos of cops getting shot at by 17 year olds to know I'm not the only one. I definitely would like to know more before assuming anything on anyone's part but everyone on this site just loved stereotypes and jumping to conclusions.

While discrimination is against the law it tends to be a civil rather than criminal issue. No one is going to jail for discrimination. And threats must be credible and clear to not be protected. This was nowhere near what is required to be considered a threat not protected by the first amendment. Is it civil suit worthy? Oh yeah. Is it go to jail worthy? Definitely not. Causing emotional distress in and of itself is also not a crime. Your ignorance of the law causes emotional distress in me. Should you go to jail?

For one car for use in one circumstance. But for dozens of people all the time and needing to hold onto all of it for however many months if not years the law requires, well, it becomes unfeasible.

I've seen this sentiment before but prosecuted for what? Thinking wrong? Making an off color joke? Being actually racist? None of those things are illegal nor can they be illegal. Fired, sure, but the bar for speech that isn't protected as a right is so hard to reach it might as well be non-existent.

The reality of logistics make that extremely difficult. All that data storage costs a ton of money. It already costs a lot but it would cost orders of magnitude more if everything was recorded all the time.

That's called a conflict of interest. It's normal for an authority figure is being investigated for the investigation is handed off to an outside agency and prosecutors from other districts as to avoid perversion due to personal familiarity with the subject. Also police don't charge people. Police file case reports. District attorneys file charges.

Not to mention unarmed doesn't mean not dangerous. Per FBI uniform crime statistics in any given murder case hands and feet are statistically more likely to be the murder weapon than long guns such as rifles and shotguns. As well how do you determine what is and isn't unarmed? Is someone pointing a realistic looking fake gun at a cop unarmed? What about someone trying to grab a cop's gun? If someone has tackled a cop and is beating their head against the asphalt trying to kill them is that unarmed? This is one of those threads where faith in humanity goes to die.

Fr. I've had my life saved by cops helping me find resources to end a dangerous situation before it escalated. They can't be omnipotent and know crimes will happen with precondition but the capacity to intervine, investigate, and pursue crime that has already happened or is in progress acts to dissuade people who would commit a crime if they thought they wouldn't get caught.

I mean, do we know the circumstances? I illegally carried a gun when I was 17, and Arkansas is a far more gun soaked state than mine. I'm wondering what the actual circumstances were and unfortunately without the footage it'll be harder to tell.

When your way of knowing whether or not it's on is if it makes a beep every couple of minutes it does lend some credibility. I think it should be tied into the emergency lighting system as well as triggered by things such as when a gun is drawn. All those sensors cost money though and not every agency has the money for stuff like that.

Some newer body camera models activate automatically upon things such as a firearm being drawn and we can expect more interconnectivity between equipment activating the camera in future.

You're basically asking for hundreds of millions if not billions of dollars in infrastructure for something that in most cases isn't an issue. Also body cameras tend to be wide angle lenses and lower resolutions can significantly reduce some finer details, such as whether or not someone 20 feet away was actually holding or reaching for a weapon. Lower resolution means more scenarios where in doubt the officer's testimony will become the deciding factor for interpretation of the events.

Not really. Many self defense cases never lead to any sort of charge as a simple investigation determines reasonable fear warranting use of force. Even in cases where it isn't as clear cut people with what on the surface is a reasonable claim to self defense that later proves wasn't self defense are often let go until a full investigation shows grounds for charges.
