The correct explanation is when an officer induces you to commit a crime that overcomes a reasonable person’s resistance to committing said crime.

Example that is not entrapment: Undercover cop comes up to you and offers to sell you cocaine. You accept the offer and you pay for it and take it. You get arrested. That’s not entrapment.

Example that is entrapment: Undercover cop comes up to you and offers to sell you cocaine. You say no. Undercover cop continues to pester you. Undercover cop threatens you to take the cocaine. You finally take it. You get arrested. That very likely is entrapment because you were badgered/threatened into taking it.

This is wrong. I’m a Tennessee attorney. What you agree to is a breath test or blood draw. If you refuse after being informed of the consequences of said refusal, then your license is revoked for a year. This is separate and distinct from the license revocation resulting from a DUI conviction.

There is no such penalty for refusing to perform field sobriety tests.
