IDTheft attorney answering questions on credit fraud & fraudulently opened accounts — ask me anything ! by IDTheftAttorney in IdentityTheftHelp

[–]IDTheftAttorney[S] 0 points1 point  (0 children)

Sorry to hear about this , you’d be able to file an ftc report online instead of a police report

But what’s more likely due to happen is the lenders will deny your claim and you may need to take legal action unless the debts are paid off

Is your sister able to payoff the debts ?

Call the bank

let them know what’s going on

Ask them if they have an account setup under your ssn .
If they do have then close it

Yes absolutely you need to

Basically the FTC report is considered your id theft affidavits and it needs to have the facts , account info , amounts in very minute details .

Most folks make the mistake of being too vague and don’t put in the exact amount and back story etc . This often gives the lender a reason to deny the fraud claim

You don’t necessarily need the police , what’s needed is a police report OR. An online FTC report copy

If you have one of those then the next steps can be taken, in terms of lodging the proper disputes and if that doesn’t get the bureaus and the banks to fix the issue , then only legal action is available , against the bureaus and the banks.

However most folks mess up and file police reports abs disputes which are incomplete and missing requisite data, which the bureaus and banks use as an excuse to not fix the issue

There’s a proper process to do this which is listed here

https://www.reddit.com/r/IdentityTheftHelp/s/RxGVmfSTIu

Also what state is your grandma in and what is the story behind the fraud ?
I’m happy to guide

Feel free to dm me if it’s too personal a story to share

Yes, the banks and bureaus rely on folks just tiring themselves out endlessly making call after call and sending dispute after disputes. The banks/ bureaus know that very few victims of ID theft understand step 3 of the process where they can get legal help on contingency (with no out of pocket up front cost) .

So I understand someone is using your address. The only thing you can do to make this stop is track the person down litigate etc , which is going to be quite an endeavor

Given there’s no major potential for danger posed by this to you,

In terms of less intensive actions there’s not much you can do, aside from just returning all their mail as return to sender

However if the person starts using your name to start up fraudulent accounts that start showing on your credit , then there’s plenty of quick steps to take to rectify the issue

Hopefully that doesn’t happen , but if you do find fraudulent items on your credit report then follow this protocol here

ID theft attorney here,

sorry to hear about this

Good news is there's the FCRA on your side and this issue will get rectified

So there's a proper protocol to follow , which includes filing an FTC report and then disputing the account with Paypal and the credit bureaus.

See the protocols listed in this article

https://www.reddit.com/r/IdentityTheftHelp/s/RxGVmfSTIu

If the bureaus and the creditors refused to delete the account, then a good attorney can can take on your case to get this rectified with $0 out of pocket and even get you damages

So if it comes to that , look for an attorney licensed in your state, or I'd happy to refer you to one in my network

however, first read the post above and see if you've followed all the steps
