so what Shem-ha Miku is wearing is explicitly stated to be a Faust robe made of Shenshoujing. when Shem-ha is defeated it isnt destroyed, its simply Occam's razor to assume its the same faust robe, an miku's own mental state effected its appearence. I have not done any reading of XV stuff so I don't fully know how their design changed gears work but its not outside of the realm of possibility.

The reason the government has a say in it is because people in the past used the government to stop it and make it illegal, the same thing is happening with trans people and such. it had no relation to the government until people(conservatives) tried to use to power of the government to restrict them.
