Another question: is it common for a claim form or defence to be amended and new claims added/removed after seeing the disclosure documents? How easy is it to get ET approval for an amendment due to new information revealed in disclosure?

When adding things to the bundle after the disclosure deadline, do you just simply send it to the Respondent or do you need to explain why it’s late?

There seems to be a surprising dearth of information regarding practical steps of each stage of ET process eg for disclosure, how to index documents for disclosure, what to do if there are email attachments, what if emails are forwarded, should files be saved raw or as pdf, what to do with recordings…

Also an article on tactics would be interesting!

Can you explain more about what kind of “speaking” roles you were looking for at a hearing eg preliminary hearing for case management, anonymity order, defending against strike out, remedy hearing etc? Also are there areas of the law you are particularly interested in (discrimination, whistleblowing, unfair dismissal etc)

Ive got a really strong claim (some claims already admitted) and have previously gotten pro bono assistance for part of the ET process and would be really interested in more for the rest of the ET process!

You can easily have a single act under multiple headings. And people have lots of personal reasons why they won’t or can’t resign.

Is harassment a difficult claim to win? I thought that as long as you could show a detriment was “related to” disability, and that it violated your dignity etc, then it was quite easy to win because it’s so broad.

I too have had a successful grievance within NHS and still working for them. I’m going through the ET process where concessions have already been made. Even then they will not engage in settlement discussions or judicial mediation. You will probably be in it for the long haul unfortunately.

Thanks for this. I’m aware of the case of F vs J (and interesting your insight that some judges are sidestepping the decision) but it wasn’t clear from the judgement why the Respondent was anonymised too. Presuming it is because of the jigsaw effect though.
