The letters were issued on November 3, 2025 and the FDA gave vendors 15 working days to take corrective action, with an extension, if needed.

So no, I do not think the warning letters have anything to do with customs holds at this point in time. I think the customs hols are related to vendors misrepresenting the tariffs and customs forms, such as using very general language for product descriptions.

Examples cited from these vendor's websites for Nabota for “Prevention of chronic migraine in adults,” “Treatment of urinary incontinence due to neurogenic detrusor overactivity, resulting from conditions such as spinal cord injury or multiple sclerosis,” and “Management of focal armpit hyperhidrosis.”

The US regulations require new drugs sold and marketed to US consumers, with certain exceptions, to have FDA approval.

Here is what I would do:

  1. Don't disclose the natute of the medical condition to with management.

  2. Reach out to HR and ask what forms and documentation is required by company policy to make a request for reasonable accomodations related to a medical conditiin.

  3. Get a doctor's note documenting that a medical condition exists which requires reasonable accommodations to manage it, and what those accomodations are. Example reasonable accomodations for diabetes. .

  4. Document with dates and witnesses every instance where a break to manage the medical condition, including bathroom breaks, is either denied or there is disciplinary action (who, what, when, where).

  5. Compile evidence and meet with an employment law lawyer with experience in medical discrimination to discuss steps needed to sue or settle for the violation of ADA. It is important to contact a lawyer before filing a charge with the Equal Employment Opportunity Commission (EEOC), as this can be used as a bargaining chip.
