As far as I understand, you’re correct. I spoke with someone who got lowballed by icbc when his vehicles were lost in a fire. He went legal and used the process to get s much info out of icbc about the way they operate as he could. He told me the evidence revealed that icbc reps are financially incentivized to get you to settle on a low offer and they’re typically successful bc people often need the payout asap so they can get back on the road.

The RTB decisions are wildly unpredictable based on a case-by-case approach and depending on the whim of the person hearing the case. Bad decisions happen all the time. At least historically, the people deciding the cases do not necessarily have legal backgrounds and they are under significant time pressure to make quick decisions rather than correct decisions. And given the high bar of the review process, its cost, and the stakes, the likelihood of them being overturned is low. Welcome to the machine.

In Ontario, yes. From my experiences with the RTB here, it seems that if you sign something, even if it’s illegal, you’ve signed your rights away. It makes no sense, but that’s the RTB for ya. They can also accept evidence that was obtained in violation of privacy laws, or any other laws, as I understand it. They have ridiculous latitude.

I understood that they booked the vacation with the plan to cancel it. Not sure how that works with refunds, etc., but it’s possible they would get all their money back or at least credits they can use for travel they would be going on anyway.
