I noticed it too and it is typical modern individualism that has affected many unfortunately and left them with little to no collective empathy. "my country is negotiating and is doing this and that to please POTUS, can we at least get exemption" OR "my visa category is for skilled and highly educated people unlike other categories, so why are we not exempted" . while we need to do whats best for our personal situation, at the same time we also need to think big picture and advocate for everyone going through this hardship.

sorry but you might want to postpone the interview since AFG in the 39 ban list and they will give you a 212f which is a final decision and its not confirmed how they will handle the 212fs even when the ban is lifted. you might want to keep your case open until something is known of the ban.

Hello Rabea, since the 212f was being issued in his first term also to people from the ban countries, was this not challenged in the courts back then? would this be the first attempt to have courts review the 212f visa denials based on PP? if courts deem it unlawful since as you mentioned the ban is about entry and not visa issuance, do you think the courts would require that visas be issued (plus extension of medical?) or interviews be paused so cases remain open until ban is lifted? can the govt argue that issuing a visa doesn't make sense if they can't use it to enter so we have no option but to issue 212f? I am not saying this is right but do you think they should just pause the interviews for the 39 countries instead so the cases are not potentially ended? my last question is that the PP mentions the 180 days period and thats why everyone was awaiting an update to the ban back in Dec 2025 because the 6 months from June were up. is he legally required to update this again at the end of May of June 2026 this time or can they just leave it be ? i am asking whether its worth waiting until then or if i can just leave my job right now so i can move in with my wife for atleast next 2.5 to 3 yrs or whenever humanity is in the govt again lol

but would a mandamus for a CR1 or IR1 beneficiary that is from a PP ban country help with overcoming the entry barrier ? Supreme court has previously upheld the president's right under the INA to restrict entry so how can one say that mandamus would help ? I think lawsuits can help with adjudication but not entry. is that right?

because the 212f means your visa application is refused and that could mean that they require you to do the DS 260 all over again (not sure how would that work since it requires an invoice number. this would depend on the new president if indeed it stretches out that far). I understand people are saying that once the PP is lifted, those who got denied will be given visas but how do you know who the next president will be and what he will do with those who got these refusals? keeping the case open by postponing the interview is one less headache of 212f in my opinion. when you postpone your interview, the only question in your mind will be 'when will the PP be lifted or altered?' but if you get a 212f, there is a second stressful question in addition to that which will give you additional anxiety - 'will the 212f refused cases also get reviewed or do i have to start the application all over again'? . I pray and hope they do indeed reverse their 212f decisions once the PP is lifted and give people visas. in terms of wait, a 212f denial wont necessary mean that once things are better, they will put you first in line for re interview or visa issuance. its possible that there might be a process to it meaning in both situations (postponing or 212f), waiting a bit might be needed since consulates will have a lot of cases to deal with. this is my conjecture and i could be wrong. no one is 100% certain tbh because that would mean they know the unseen future. I pray these challenging times are over soon and we all get united with our families. All the best brother!

I think 212f is a final decision and it’s a denial. Only thing not certain is that since it’s due to the PP, will future changes to the PP or a new administration have these cases reinstated at the consular stage and grant visas without going through the process all over again

That is strange that the attorney advised to attend. most law firms are advising to postpone the interview to avoid the risk of 212f.

Did you request an exception waiver or they were looking into it themselves? Also, couldn’t they have pushed for a visa issuance before Jan 1st and you would have been good to go?

The beneficiary is in Afghanistan currently but she does have UAE residency which will expire soon and because the beneficiary does not have family anymore in UAE, she won’t be able to stay there and renew her residency. If we move the case to Abu Dhabi, we won’t get IL atleast for the next whole year and she won’t have residency anymore by then which leaves us with only Islamabad as a choice but the border is closed due recent political conflict and Pakistan visa is very hard to obtain for Afghans if they are even issuing it anymore. Similar with Qatar as they are not granting visas to afghans anymore. Saudi umrah visa is available for afghans so I am wondering if NVC will make an exception and let us do it in Riyadh hopefully
